The domestic laws that prohibit the use of torture should also be enforced.

Now the United States was even attempting to legalize the use of torture.

Yet torture is still reported even in those countries.

According to non governmental sources, the use of torture against suspected supporters of the East Timorese resistance movement was widespread, despite the fact that it was prohibited under the Indonesian Criminal Code, the Code of Criminal Procedure and various ministerial regulations.

In its reply of 15 September 1997, the Government denied that any torture had occurred.

We should make use of this day to bring torture to the renewed attention of the world s conscience.

Reaffirm the concerns highlighted in our previous joint statements, re emphasize the absolute nature of the prohibition of torture, including the principle of non refoulement where there is a danger of an individual being subjected to torture, and stress that no exceptional circumstances may be invoked as a justification for torture.

32. The government authorities with whom the Special Rapporteur met were unanimous in condemning the use of torture.

He notes that in no case has a police or security official been convicted and sentenced for torture.

The Special Representative welcomes statements against torture by the Minister of Justice and Minister of the Interior and the beginning of efforts to discourage law enforcement personnel from using torture to extract confessions or impose punishment.

In its resolution 1997 38 the Commission on Human Rights requested the General Assembly to proclaim 26 June a United Nations International Day in support of the victims of torture and the total eradication of torture, and the effective functioning of the Convention against Torture, which entered into force on 26 June 1987.

The use or threat of use of weapons that per se violate humanitarian law, such as those listed in resolution 1996 16, can be regarded as torture under the international definition of torture set out in article 1 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

The Special Rapporteur on torture had received allegations of the extensive practice of torture by the Turkish police.

Allegedly, the organization was not permitted to make use of the word torture in its name.

3.4 The complainant believes that systematic practice in the State party, exemplified by failure to investigate cases of torture promptly and impartially, protracted investigations, the imposition of minimum sentences, the retention in the security bodies of persons accused of torture and the promotion, decoration and pardoning of persons accused of torture, allows torture to go unpunished.

Recommendation 1 was more consistent application of the definition of torture .

He also urged Governments to declare formally that torture was absolutely prohibited in all circumstances.

The use of torture for the purpose of extracting confessions or gaining information is prohibited under article 38 of the Constitution.

Torture appears to have had a long history in the Islamic Republic of Iran it was certainly widely practised in the Pahlavi era.

Other reports alleged resort to torture and ill treatment by the police, particularly during pre trial detention. Torture was mainly reported to occur immediately after arrest or during interrogation to intimidate detainees or to extract confessions.

The allegations were much more serious this time and included claims that he had been subjected to torture involving the use of electricity.

They have also experienced difficulties in documenting instances of torture, thus facing the risk of the rejection by the court of the torture complaint of their clients.

4. Torture

Torture was said to be inflicted systematically against such detainees.

The Government further assured the Special Rapporteur that no detainee would be subject to torture at the hands of Israeli officials.

The torture was said to include severe beatings, which left him unable to breathe properly.

While welcoming his categorical emphasis on the absolute nature of the prohibition of torture and other forms of ill treatment, he noted that, since everyone denounced torture, acts of torture were committed in secret he would like to know how to resolve that paradox.

He maintains that his confession was obtained by means of torture.
