The claim preparation costs in claim No. 5000464 relate to all of Jordan's fourth and fifth F4 instalment claims, and not only its public health claim.

The total amount asserted for claims preparation costs is USD 76,339.12.

The E2 claim alleges company losses totalling USD 629,149.

In the view of the Panel, this will not only accelerate recovery of the damaged areas but it is also in line with the duty of Saudi Arabia to mitigate the damage and to minimize losses resulting from the damage.

The fourthsecond group of overlapping claims initially consisted of E4 claims related to 39seven category C claims and 24 category C and D claims.

Also included in this report is one E2 claim, that is a claim submitted by a non Kuwaiti corporation, public sector enterprise or other private legal entity (excluding oil sector, construction engineering, export guarantee insurance and environmental claimants) (the E2' claim ).

A total of 37 confirmed matches were identified, which related either to claims filed by the same claimant within the bedoun programme or to claims filed by the same claimant in different claim categories.

There are also three claimants in this instalment whose individual claims for C8 Business losses were determined to be claims for corporate losses.

The E4 claims population consists of claims submitted by Kuwaiti private sector corporations and entities, other than oil sector and environmental claims, eligible to file claims under the Commission's Claim Forms for Corporations and Other Entities ( Form E ).

The largest group of claims consists of the 29,051 claims that were previously determined to be provisionally eligible as a result of the electronic application of the Governing Council's eligibility criteria to each claimant's data in the PACI database.

Of the 24 company claims in this instalment, 19 are stand alone claims four are corporate detainee claims and one is an E2 claim.

(e) Category E, from corporations, other private legal entities and public sector enterprises

Overall, there are 31,31,70 claims that the Panel has determined to be ineligible for inclusion in the late claims programme because the claimants failed to provide satisfactory reasons for late filing.

The majority of the claims in the fourthsecond group of overlapping claims were filed by an E4 claimant and an individual claimant who was a shareholder of the E4 claimant company.

As stated in paragraph 21, a total of 29,065 claims were filed by such claimants.

As stated in paragraph 22, a total of 398 claims were filed by such claimants.

As stated in paragraph 25, a total of 1,446 claims were filed by such claimants.

The E4 population consists of claims submitted by, or on behalf of, Kuwaiti private sector corporations and entities, other than oil sector and environmental claimants, eligible to file claims under the Commission's Claim Forms for Corporations and Other Entities .

During the course of the Panel's review, two claims with a total claimed amount of USD 162,456.74 were withdrawn, leaving a remaining total claimed amount of USD 866,037,400.07.

Having concluded that this consolidated claim, in effect consists of 82 claims, comprising 67 managing agent and 15 insurance company claims,

Stand alone claims are corporate business losses filed by individuals.

Iraq, therefore, states that the claim unit should be dismissed.

As a result of these matching procedures, the Panel determined that a total of 4,4,82 claims or nine per cent of the total claims population were not eligible for inclusion in the late claims programme.

In twofive of the individual claims identified as potentially overlapping with E4 claims, the Panel considers that the claim wass were not overlapping as the individual claimant was weres claiming losses that were related to the E4 claimant companies but were not overlapping losses (for example, where the individual claimant is seeking compensation for a loss of salary or management fee from the E4 claimant).

Overlapping claims relate to claims by both the shareholder and the corporate entity for losses pertaining to the same corporate business.

Subsequently, in response to claim development, the individual claimant stated that he had no ownership interest in the company, and that his claim relating to the company was submitted in error by his claim preparer.

During the course of its review of claims in the special instalment, the Panel identified one claim that included D8 D9 (individual business) losses in respect of two ready made clothing businesses that were also the subject of a category D claim filed by an Indian claimant in the regular claims programme, which was awarded compensation.

However, Iraq argues that Kuwait has based its calculation of damage to the shoreline resources on computer models and natural resource damage assessment ( NRDA ) data from the United States with limited adjustments for the Kuwait situation .

In this claim, which was submitted on a category E (corporate) claim form, the Claimant seeks compensation in the amount of US 951,630,871 for the costs allegedly incurred in

Observing that in the course of claims processing, a number of category C , D and E competing claims were identified where two or more claimants claimed for the losses of the same business or company,

In three instances, the company and the individual claimant were partners in joint ventures.

Three of the claims in this instalment include a claim for what the Panel considers to be the individual claimant's equity interest in a company.

Where claimants state on their claim forms that their business is located in either Iraq or Kuwait, the claim is not individually reviewed but electronically processed.

On 20 August 2001, the secretariat severed the parts of claim No. 5000194 relating to these studies and assigned them to claim No. 5000453.

During the course of the Panel's eligibility assessment of claims, a total of 10,10,35 claims were scrutinized for potentially irregular documents submitted by claimants.

For their part, the Claimants concerned assert that they are entitled to submit claims for public health losses.

Second claim unit Marine and coastal resources The second claim unit is for compensation for damage to marine and coastal resources.

This claim was originally part of category F3 claim No. 5000194.

Iraq further argues that Syria did not provide any evidence to support the alleged reduction in numbers of sheep during the five years following 1991.

This is critical to programme success.

The corporate detainee claims allege company losses aggregating KWD 3,197,757 (approximately USD 11,064,903).

During the review of the stand alone claims in this instalment, one instance of a related category C claim was identified where a category D claimant had already received an award for the company's losses.
