Some countries have constitutional guarantees of human rights with practical enforcement mechanisms, such as the Canadian Charter of Rights.

Additionally, the Constitution fails to make reference to non derogable rights.

Rather, it is a constitutional balance between the branches of power, each of which must strictly adhere to its constitutional powers and responsibilities.

The existing legal acts do not provide for a definition of an elderly person .

The new constitution will enshrine the ideas of any free people in its charter pluralism, democratic rights, federalism, human rights and civil liberties.

181. On 5 February 1993, the internal rules of the Democratic Constituent Congress were adopted, establishing among its commissions the Pacification and Human Rights Commission, whose role is to secure the fundamental and constitutional rights of individuals.

Any restrictions on the issuance of passports or on the right to leave and return to the country, for example, would immediately be challenged on the ground of unconstitutionality before the Constitutional Court.

A restriction that was so general as to dilute the very substance of this right would be unconstitutional.

15. The Constitution of the Czech Republic was adopted on 16 December 1992 and promulgated as Law No. 1 1993 Coll. Article 3 of the Constitution stipulates that Part of the constitutional order of the Czech Republic is the Charter of Fundamental Rights and Freedoms .

The Constitution Drafting Committee has also established subcommittees on federalism and human rights.

Other relevant human rights mechanisms have recommended that there should be no possibility of derogation from rights such as habeas corpus and amparo.
