The detention of individuals should be accompanied by adequate judicial oversight, which is often absent.

In the context of service control and legal control, the Land ministries of justice examine whether the actions of prison staff are legal. Specialist control entails examining whether staff also act in accordance with their profession.

Ministry officials have also started to collect judicial statistics in an effort to oversee the work of judicial officials.

38. Oversight by the Ministry of Justice is also a key factor for a well functioning justice system.

The work of each cluster falls within the supervision of one of two Principal Legal Officers (D 1), with overall direction and supervision coming from the Director of the Division.

At the administrative level, each category monitors the judicial activities of the courts below it.

C. Monitoring of the police stations, courts and prisons

Established by a decree of 29 June 1995, APENA, under the direction of the Minister of Justice, is responsible for the management and supervision of Haitian prisons.

I am delighted to report that the long awaited Provedor for Human Rights and Justice has recently been sworn in by the National Parliament.

Its role is to oversee the functioning of the justice system, appoint judges, and decide on disciplinary action against court personnel when required.

The Division provides a single oversight mechanism for programme formulation, implementation and evaluation.
