The Appeals Chamber has disposed of 30 appeals, from both this Tribunal and the International Criminal Tribunal for Rwanda (ICTR) since the last report.

The Appeals Chamber decided five appeals from judgement, as well as 23 interlocutory appeals.

The Court of Appeal is based in Nouméa and there is access to the higher appeal court of France in certain matters.

Every indictee must face his indictment and appear before the Tribunal to answer the charges brought against him.

That makes it the fastest prosecution case in the Tribunal's history.

178. As at August 1998, public indictments had been issued by the two Tribunals against almost 100 people 60 by the International Tribunal for the Former Yugoslavia and 36 by the International Tribunal for Rwanda.

The author contends that the court proceedings against his son apos s aggressors were biased, and that the defendants were allowed to quot distort quot evidence in court.

II. Summary of indictees still at liberty at the end of the reporting

She indicated that a significant number of prosecutions had been brought in a number of European countries and that the number of these prosecutions might exceed the number of prosecutions by the International Criminal Tribunal for the Former Yugoslavia.

325. Dominican legislation confers equal treatment on men and women in the courts, so that women can sue and be sued according to the same legal prerogatives as men.

The Committee notes that it is undisputed that the author withdrew from the proceedings at the first stage at the Family Court, and subsequently, after having filed an appeal, withdrew his appeal to the Full Court against the judgement of the single judge of the Family Court.

In February 1996, in the case Ibrahim v. Emein, Justice Muhammad, sitting in the Court of Appeal, said

You will not be prosecuted before a secret military court as I first had in mind.

He filed two criminal complaints and a complaint with the Vienna Independent Administrative Tribunal.

I turn now to the Tribunal for the Former Yugoslavia, which continues to receive new indictees.

9.3 As regards the claim that Mr. Burrell apos s representation on appeal was inadequate, the Committee notes that it appears from the judgement of the Court of Appeal that Mr. Burrell apos s legal aid counsel for the appeal (who had not represented him at the trial) conceded at the hearing that there was no merit in the appeal.

On 21 September 1990, the Constitutional Tribunal rejected his complaint.

Of the 4 claims, three claims have been satisfied, while in one case court proceedings have been closed.

With regard to the appeal, the authors claim that counsel who represented them before the Court of Appeal failed to consult with them before the appeal hearing, at which the authors were not present.

I don't intend making this sort of plea to the courtmartial.

Confirmed the first indictments of the Tribunal in November 1995.

2.3 The author appealed to the Hague Court of Appeal and, at the beginning of the hearing, sought referral of the case to another Court of Appeal, for the same reason as in 2.2 above.

While the national courts remain technically competent, it was clearly the intention of the legislator to entrust the prosecution of past crimes to the international tribunal.

The Criminal Code has provisions for punishing violence against women.

Moreover, it transpires from the facts that the Trial Court conviction of the author was reviewed by the Court of Appeal, which is a higher tribunal within the meaning of article 14, paragraph 5.

The imposition of counsel was appealed and ultimately reversed in part by the Appeals Chamber.

Three additional proceedings in the same court are currently under way or should start soon.

Special courts had been established for the prosecution of corruption cases, several of which were pending.

The appellants then commenced action in the Singapore High Court.

A Chief of Prosecutions will need to be recruited to coordinate the prosecution activities, particularly at the court level.

The author was indicted by the First Chamber of the Provincial Court of Malaga (Sección Primera de la Audicencia Provincial de Malaga).

As the Appeals Chamber's workload increases, consideration is still being given to increasing the capacity of the Appeals Chamber by having two Benches of five Judges available for the disposition of appeals.
