If the prohibition on reservations applied only to certain articles, or, conversely, if reservations were authorized only for some provisions, the depositary must refuse such reservations as were not in accordance with the provisions of the treaty.

Depositors in the Bank had demanded that the Government guarantee full repayment of their deposits.6

Present paragraph 3 should be retained and renumbered as paragraph 4.

When article 21, paragraph 3, stated that the provisions to which the reservation related did not apply as between the objecting State and the reserving State to the extent of the reservation, it was referring to reservations permitted under article 19.

There was a real duty for depositaries under that subparagraph that they must discharge for all instruments they received, including reservations.

A reservation is prohibited by the treaty if it contains a particular provision

One view was that paragraph (4) should be retained.

The provision to which the reservation relates constitutes the raison d'être of the treaty or The reservation has the effect of excluding its author from a dispute settlement or treaty implementation monitoring mechanism with respect to a treaty provision that the author has previously accepted, if the very purpose of the treaty is to put such a mechanism into effect.

Reservations formulated by virtue of a reservation clause which did not specify what reservations were permitted should be subject to the compatibility test.

Other delegations asked that the confidentiality clauses should be retained.

266. The Committee expresses serious concern at the continuing existence of a reservation to article 11, subparagraph 2 (b), on paid maternity leave.

The commentary to that article then explained that article 57 was a saving clause which reserved two related issues from the scope of the article.

The final obligations under this contract relating to retention monies and a retention bond owing to the contractor were subsequently released (see para. 16).

3.1.8 Reservations to a provision that sets forth a customary norm

Over the past year, progress was made towards implementing the European Union s Deposit Guarantee Directive (94 19 EC), to provide protection for bank depositors.

(b) The declarations referred to paragraph 1 (a) of this Article shall be deposited with the Depositary, who shall immediately inform the High Contracting Parties of any declaration received under this paragraph.

Tunisia made a reservation to article 16, paragraph 2.

A saving clause accompanied by a commentary should be sufficient.

After discussion, the Working Group decided to retain both paragraphs (7) and (8).

The Government of the Niger has also expressed a reservation concerning article 29, paragraph 1.

(i) Cash and term deposits comprise funds on deposit in interest bearing bank accounts, certificates of deposit and call accounts

The seller retains title or the lender is granted a security right in the tangibles purchased to secure the repayment of the credit or loan.

Finally, the revolt of Cyprus s small savers highlighted the need for a credible system of deposit insurance. The EU directive that stipulates the protection of bank deposits up to 100,000 does not provide a European guarantee it only requires member states to create a deposit insurance system at the national level.

He stated that collective rights did not exist in international human rights law, and therefore his Government had reservations with regard to those articles which aimed to establish collective rights.

The Working Group had therefore decided, on balance, to retain the provision.
