8. Moratorium

77. Nigeria should establish a moratorium on executions, with a view to completely abolishing the death penalty.

Welcoming the efforts of various sectors of civil society at the national and international levels to achieve the abolition of the death penalty,

Welcoming the fact that many countries that still retain the death penalty in their penal legislation are applying a moratorium on executions, and also welcoming the regional initiatives aimed at the establishment of a moratorium on executions and the abolition of the death penalty,

(a) To abolish the death penalty completely and, in the meantime, to establish a moratorium on executions

We also extended the moratorium indefinitely.

The Commission on Human Rights has continued annually to adopt resolutions calling upon all States that have not already abolished the death penalty to consider establishing a moratorium on executions with a view to completely abolishing the death penalty.

On the contrary, in the case of suspensions, the reinstatement of the status at the end of the suspension period should, in principle, be automatic.

(c) The intention of the Government of the Democratic Republic of the Congo to suspend the moratorium on the carrying out of the death penalty

In accordance with the latter, Governments should consider the imposition of a moratorium on executions.

Also, the United Nations Commission on Human Rights has called on States which have not yet abolished capital punishment to consider suspending executions with a view to the eventual abolition of the penalty.

It further called on States to consider suspending executions, with a view to abolishing the death penalty.

In resolution 1998 8 of 3 April 1998, the Commission on Human Rights called upon all States that still maintain the death penalty to establish a moratorium on executions, with a view to completely abolishing the death penalty.13

Where relevant, the Union is also pressing for moratoria to be introduced.

Hence, the situation was different from a mere moratorium where capital punishment remains in the law in books but its application is suspended in practice.
