6. In case of a resignation of a member of the Tribunal, the resignation shall be addressed to the President of the Tribunal for transmission to the Secretary General. This last notification makes the place vacant.

Subsequently, before being appointed as judges, they were required to complete at least one year of training as a judge apos s clerk and deputy.

The judges of the International Court have no such legal clerks at all.

None serve as clerks to the judges.

During my 40 years professional career from 1965 to 2005, I practised at Bar on both criminal and civil sides for 13 years, served as Judge, Presiding Officer of different categories of Courts for 23 years deciding thousands of judicial cases and served as Head of Administrative Posts i.e. Secretary Law and Parliamentary Affairs.

In addition, the Court will seek a pool of clerks to assist the Members of the Court, a pool of interns for the Registry, a secretary for each judge and a Professional assistant for the President.

Responsibility for the accounts is assigned to the Registrar who shall establish all accounting procedures of the Tribunal and designate the officials responsible for performing accounting functions.

Each reporting judge is paid a fee of 1,500 Swiss francs for writing each judgement each of the other two signatories is paid SwF 375 for signing each judgement.

After the author had accepted the conditions of appointment, including his prior resignation from the post of Family Court judge, the Chief registrar sent him an offer of appointment to the post of District Court judge (with the starting salary of the scale for District Court judges) and advertised the author's post of Family Court judge.

It is still under discussion between the Office of Legal Affairs of the Secretariat and the Registrar of the Tribunal.

In 2004, judges and staff members of the Registry also delivered lectures and published papers on the work of the Tribunal.

Briefings on the operations of the Tribunal included presentations by the President of the Tribunal, the Prosecutor and the Deputy Prosecutor, the Chief of Investigations, the Chief of the Security and Safety Section, the Registrar and the Deputy Registrar, the Chief of the Budget and Finance Section and the Commanding Officer of the Detention Unit.

16. The greater workload of the Court has also meant that for judges and Registry professionals, secretarial support, already modest, has become quite inadequate.

During its consideration of the reports, the Committee met with the Deputy Prosecutor, the Registrar, the Deputy Registrar and the Chief Administrative Officer of the International Tribunal for the Former Yugoslavia, with the Chief of Prosecutions and the Registrar of the International Criminal Tribunal for Rwanda and with other representatives of the Tribunals and representatives of the Secretary General, who provided additional information and clarification.

A draft proposal has been sent to the Registrar for consideration and approval, in consultation with the President of the Tribunal.

The composition of the Chamber, in order of precedence, is as follows Judge Marsit, President Judges Caminos, Yankov, Park, Mensah, Chandrasekhara Rao, Anderson, Jesus, Xu, Cot and Lucky, members.

Should the General Assembly decide that UNAT United Nations Administrative Tribunal members are to be compensated in a manner comparable to ILOAT International Labour Organization Administrative Tribunal judges, the General Assembly may wish to consider honorariums as follows the UNAT member drafting a judgement would receive 1,000 the two members signing the judgement would receive 250 for each case.

Legal and secretarial support for the Chambers is budgeted in 1999 under the provisions for the Chambers Legal Section of the Registry.

With the recruitment of a Deputy Registrar, the Judicial and Legal Services Division of the Registry now has the essential link required for the ongoing systemization of the function of judicial support to the chambers and the other parties in the proceedings before the Tribunal.

This law, which has not been drafted, would address issues such as the role of trial judges, investigating judges, prosecutors and clerks, the training of judges, membership in political parties, conflicts of interest, and ranks and salaries.

The emoluments of the judges will depend upon the action the General Assembly takes on the report of the Secretary General on the conditions of service of the members of the International Court of Justice (A C.5 53 11).

The case was first referred to a single judge of the Court but later assigned to the full Supreme Court by the Chief Registrar.

Judge Khan also expressed the view that he had no competence with respect to the individuals in the second group, since they fell within the competence of the previous confirming judge he also maintained that such an indictment could have been issued in respect of the third group, had it not been for the Prosecutor s insistence on maintaining the indictment as it stood hence the Judge s refusal to consider the substantive aspects of the charges against that group.
