37. The experience of the ad hoc tribunals in the former Yugoslavia and Rwanda underlined the importance of an effective, independent and permanent international criminal court, which would obviate the need for ad hoc tribunals in the future.

2. Recommends that the Extraordinary Chambers should have subject matter jurisdiction consistent with that set forth in the Law on the Establishment of the Extraordinary Chambers in the Courts of Cambodia for the Prosecution of Crimes Committed during the Period of Democratic Kampuchea

In three countries, special military or police courts were established to deal with such crimes.

The establishment of the Special Court is a positive development.

The Family Courts Act, 1964 provides for constitution of Special Family Courts to adjudicate family cases e.g. divorce, maintenance and custody of children, etc.

Moreover, the Commission discounted the possibility of either establishing an ad hoc international tribunal or expanding the mandate of an existing tribunal.

Article 1 of the new Act stipulates, there shall be established, within the courts of first instance and military courts, specialized chambers with exclusive competence to try the offences referred to in article 1 .

International judicial bodies set up for that purpose may be ad hoc tribunals established to consider the cases of specific persons (the Nürnberg and Tokyo Tribunals, for example) or institutional, established to consider a certain category of cases regardless of whether the accused are known previously or not.

In addressing the issue of security, I take the opportunity to reiterate that a crucial feature which differentiates the Special Court from the International Criminal Tribunal for the Former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR), is the location of the Special Court in the country in which the conflict took place.

The cases at the ad hoc Tribunals are legally and factually very complex.

The Committee was informed that the Special Court was considering acquiring communications equipment from UNAMSIL.

The truth commission and the special chamber will be established as national law entities.

Further, under many of the decrees establishing the special tribunals, there is no right of appeal.

Further information was also requested on the customary courts authorized by the Constitution and on the relationship between those special courts and the regular justice system.

The African Group commended the Special Court for helping to build the human resources capacities of the Sierra Leone judiciary and urged other ad hoc tribunals to follow its example.

101. The ad hoc tribunals for the former Yugoslavia and Rwanda had been set up after the fact to deal with specific crimes committed in a particular place and at a particular time.

176. The two ad hoc international tribunals, the International Tribunal for the Former Yugoslavia in The Hague and the International Tribunal for Rwanda, have demonstrated that the institutions of international justice can have teeth.

The experience gained from the ad hoc tribunals for the former Yugoslavia and Rwanda demonstrated that an international criminal court could not simply replicate national courts.

The courts of justice comprise the Court of Final Appeal, the High Court (which consists of the Court of Appeal and the Court of First Instance), the District Court, the Magistrates' Court, the Lands Tribunal, the Labour Tribunal, the Small Claims Tribunal, the Obscene Articles Tribunal and the Coroner's Court.

The Special Rapporteurs remain concerned that the death penalty may be applied following hearings before ad hoc tribunals.

To that end, the International Criminal Tribunal was established for Rwanda and mixed tribunals were established for Sierra Leone and Cambodia.
