The Syrian legislature has made a distinction among three types of naturalization first, naturalization of aliens secondly, naturalization of Arabs and thirdly, exceptional naturalization.

Section 26A of the Legal Aid Ordinance provides that a legal aid applicant who has been refused legal aid for an appeal to the Court of Final Appeal may seek a review of such refusal.

2. The Tribunal shall be open

2.11 On 30 September 1992, the author applied to the presiding judge of the Second Criminal Chamber of the District High Court (Segundo Sala Penal de la Corte Superior del Distrito Judicial de Callao) for habeas corpus, asking him to admit the application and to direct the judge of the court in Huacho to comply with the habeas corpus order.

2.3 The author lodged an amparo application before the Constitutional Court, which was rejected on 29 January 1997.

They did not apply for exemption from the normal application of the Immigration Act on humanitarian grounds.

Having considered the applications, the Department concluded that the claimants had no reasonable grounds for legal proceedings and accordingly refused their applications.

The author's first lawyer declared that applying for amparo had been proposed, but he had instead submitted an application for judicial review which had been declared inadmissible.

4.3 In relation to the authors' application for registration, the State party notes that the first two applications did not comply with legal requirements. In relation to the third application, the C.R.N.

Of course, such a third party must act with the consent of the applicant, except in situations beyond the control of the applicant.

The complainants then decided to request leave to apply for a judicial review of the decision of the Refugee Determination Division.

2.2 The author did not submit an application for amparo (enforcement of constitutional rights) with the Constitutional Court, considering that it would serve no purpose in view of the Court's repeated denial of applications for amparo for the purpose of reviewing facts established in the judgements of the ordinary courts.

On 30 May 2002, the authors filed an application in the Central Court of Minsk seeking an order to direct the C.R.N. to determine their application.

The author filed an application for review of that decision, an application that was rejected by the court on 7 July 1998.

In this case, the European Court of Human Rights ruled, on 16 September 1996, that illicit and unacceptable pressure had been exerted on the applicants to withdraw the applications they had submitted under the European Convention and that consequently the right to individual petition of these applicants had been violated.

If a party neither applies for reconsideration, nor brings a suit in a People's Court within the time limit, nor execute the decision on administrative punishment, the organ that has made the decision may apply to a People's Court for compulsory execution.

3.3 The author did not make any application to the Constitutional Court for amparo.

The Committee recalls that the definition of racial discrimination in article 1 expressly extends beyond measures which are explicitly discriminatory to encompass measures that are not discriminatory at face value but are discriminatory in fact and effect, that is, if they amount to indirect discrimination.

Had their application been turned down, the complainants could have requested leave to apply for judicial review of the decision.

Even though his lawyer subsequently, on 29 October 1999, applied for habeas corpus to the Supreme Court, this application was never adjudicated.

The reasons for putting applications on hold or blocking them should be immediately communicated to the applicant.

It was also stated that local authorities sometimes rejected applications for building permits because they were not in conformity with the relevant legislation, since they did not contain information on the procedure to be followed.

On 12 December 1991, the Supreme Court dismissed the author apos s application.

Moreover, the State party notes that the complainant did not apply to the French Office for the Protection of Refugees and Stateless Persons for refugee status or for the issue of a residence permit on grounds of territorial asylum.

The author then applied to the Supreme Court for a declaration that a judicial error had been committed.
