Creativity, innovation, information and knowledge were at the heart of economic growth and drove an effective intellectual property system.

The Economic Development Sector (EDS) of WIPO focuses on the development dimension of IP with programs to provide technical assistance to developing countries and promote IP as an aid to social and cultural development, economic growth and wealth creation.

As for personal rights over property, in accordance with Article 47 of the Civil Code, all individuals regardless of sex enjoy freedom to creations and their intellectual properties are protected by the State.

Indigenous peoples, local communities and holders and creators of traditional knowledge have been identified by WIPO as the first group of potential new beneficiaries.

50. In 1998 WIPO launched a programme of activities relating to the identification and exploration of new approaches to the use of the intellectual property system by the world s indigenous peoples, local communities and other holders, custodians and creators of traditional knowledge.

But there are high costs associated with intellectual property. Ideas are the most important input into research, and if intellectual property slows down the ability to use others ideas, then scientific and technological progress will suffer.

Likewise, at present, the Council on the Supervision of the Intellectual Property is being established which will be entrusted with the task of supervising and coordinating processes underway in the area of intellectual property in the country, formulating a uniform strategy for the protection of the intellectual property, giving directions to the respective institutions etc.

One expert noted that there is a general lack of awareness in developing countries that intellectual property represents assets that can be registered and used to generate income, and that the utilization of intellectual property as assets is important for development in an increasingly knowledge intensive economy.

These moral rights include the rights of the holder of intellectual property to be recognized and designated as the creator of the work, creation or invention, the right of the holder to oppose any deformation or change of the work, creation or invention that would harm his honour or dignity.

A presentation on intellectual property and traditional knowledge by WIPO considered different objectives for the use of, and forms of protection for, traditional knowledge.

But if China wants a dynamic innovation system, it should resist pressure by Western governments to adopt the kind of unbalanced intellectual property laws that are being demanded. Instead, it should pursue a balanced intellectual property regime because knowledge itself is the most important input in the production of knowledge, a badly designed intellectual property regime can stifle innovation as has been the case in America in some areas.

National Seminar on the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS Agreement) and Resolution of Commercial Disputes Involving Intellectual Property sponsored by the World Intellectual Property Organization (WIPO) (Manama, Bahrain, 22 23 February 1997).

Since the thrust of the Agreement was to protect intellectual creations in order to contribute to promoting technological innovation and technology transfer and dissemination, WTO member States could resort to existing mechanisms of intellectual property protection in order to cover indigenous knowledge, provided that the provisions of the TRIPS Agreement were not contravened.

Such powers should include, for example, management and use rights, commercial rights, market access, the right to revenue generation as well as fee collection and intellectual property rights.

The Office for Intellectual Property of Bosnia and Herzegovina, under the Institute for Standards and Intellectual Property, is responsible for awarding intellectual property rights on the basis of specified administrative procedures.

In the work of WIPO, particular focus should be given to defensive protection of indigenous traditional knowledge aimed at preventing unauthorized obtention of intellectual property rights over its use.

Over the past 10 years, China has become more and more innovative and has demonstrated its determination to protect intellectual property rights.

The legislation for protection of intellectual property rights, by regulating the rights of intellectual property, gives holders moral and material rights.

Intellectual property rights are rules that we create and that are supposedto improve social well being. But unbalanced intellectual property regimes result in inefficiencies including monopoly profits and a failure to maximize the use of knowledge that impede the pace of innovation.

The World Intellectual Property Organization (WIPO) organized training seminars on intellectual property rights for women entrepreneurs and invited experts in the field to speak at events for women entrepreneurs and inventors.
