165. The Committee considers that the legal restrictions on trade union freedom and the right to strike are far too extensive.

When Article 18 (1) (f) of our Constitution speaks of the freedom of association, it means primarily the freedom of forming trade unions.

According to the Trade Unions Act, persons have the right to form trade unions freely, without prior authorisation, and to join or not to join trade unions.

With regard to trade union freedoms, in 1996 the International Labour Organization (ILO) Committee on Freedom of Association considered a complaint against the Government of Cuba presented by the International Confederation of Free Trade Unions (ICFTU) concerning the refusal to grant legal personality to the Confederation of Democratic Workers of Cuba (CTDC), as well as injury, detentions, threats and other acts against the leaders of independent trade union organizations.

The same applies in cases where a worker and or an employee freely chooses to discontinue membership in the trade union.

All such means are based on the principle of trade union freedom.
