Parental responsibilities and recovery of maintenance for the child

Parents have the completely same rights and duties as far as the supporting of children is concerned, and children, regardless whether they are male or female, have the same duties related to the supporting of their parents.

The dependants of a man who owns a farm and works on it feel it their duty to help him and generally the wife or dependant daughter or sister is not likely to insist on being paid for her help.

In relation with the mutual supporting of marital partners, the law does not make any distinctions based on gender.

Provisions of articles 231 to 262 of the Family law regulate the supporting of children, parents and other relatives.

With the expected decline in the potential support ratio from 10.9 per cent in 2000 to 3.8 per cent by 2050, the poverty aspects of ageing could become worse in the next few decades, underscoring the need for formal social support and elder care.

It further states that the fact that this obligation was contained in a document conveying an agreement between the parties does not make the obligation a contractual one, for the obligation itself derives not from that agreement but from the legal obligation on parents to support their children at all times, and on spouses to support each other during the marriage, and even following dissolution if one partner is left without means.

The Constitutional Court rejected both claims on the grounds (a) that maintenance payments are not a contractual but a legal obligation and (b) that article 227 of the Criminal Code provides not for imprisonment for debt, but for punishment for an act defined in law as an offence and consisting in the failure to fulfil the legal obligation to care and provide for one's family.

3.2 The author also claims that article 227 of the Criminal Code itself violates article 11 of the Covenant insofar as it provides for deprivation of liberty for non payment of maintenance.

The Panel reviewed approximately 150 claims for D6 (salary, support, other) losses in this instalment, typically in respect of salary that was not paid as a result of Iraq's invasion and occupation of Kuwait.

The obligation to pay maintenance is one deriving from Spanish law and not from the separation or divorce agreement signed by the author and his ex wife.

On 27 October 1995, the author's ex wife submitted to examining magistrate No. 6 in Vilanova i la Geltrú a claim for recovery of three monthly payments outstanding from 1993, two from 1994 and all payments from 1995.

Although the Government has recently reduced some of the privileges given to single parent families, the Ministry of Industry, Trade and Labor initiated a special program to integrate them into the labor market, specifically those receiving income guarantees and alimony payments.

4.1 The State party argues that the communication is inadmissible because it manifestly lacks any basis in article 11 of the Covenant, the sentence having been passed on the author on the grounds not of his failure to meet a contractual obligation but of his failure to fulfil his legal obligation to keep and feed his family.

4.2 As to the alleged inconsistency of article 227 of the Criminal Code with article 11 of the Covenant, the State party notes that the former provides for imprisonment not for debt but for abandonment of one's dependent family, i.e., on grounds deriving not from a contractual agreement but from a legal requirement.

The Ministry of Industry, Trade and Labor initiated a special program to integrate single parents into the labor market, specifically those receiving income guarantees and alimony payments, with the intention of increasing single parents' earning capabilities, while raising their employment qualifications.

6.4 With regard to the alleged violation of article 11 of the Covenant by the imposition of a custodial sentence for failure to pay maintenance, the Committee notes that the case concerns a failure to meet not a contractual obligation but a legal obligation, as provided in article 227 of the Spanish Criminal Code.

They note in this regard that compensation previously awarded on individual claims arising from death in category C and category D claims was limited to medical, burial and other expenses, loss of financial support that would have gone to a spouse, a child or parent as well as compensation for mental pain and anguish to the survivors.

These are the kinds of numbers usually produced by wars and epidemics, and they imply both a dramatic drop in the number of young people able to provide for their elders and a much greater debt burden for a country that is already carrying one of the world s heaviest.
