Shells shall be made of metallic materials suitable for forming.

Non metallic materials may be used for the attachments and supports between the shell and jacket, provided their material properties at the minimum design temperature are proven to be sufficient.

Beside polymetallic nodules found on the deep ocean floor, new sources of metals are gaining in importance, such as polymetallic sulphides found in and near the hydrothermal vents that occur along fissures on the sea floor and cobalt rich crusts that occur as pavements on the sea floor.

There is also a need to regulate the prospecting for and exploration of polymetallic sulphides and cobalt rich crusts.

B. Prospecting and exploration for polymetallic sulphides and cobalt rich ferromanganese crusts deposits in the Area

Crusts have a similar metal composition to that of nodules, except that they have a relatively higher cobalt content.

These programmes address environments where polymetallic sulphides and cobalt rich ferromanganese crusts are found.

(g) prospecting means the search for deposits of polymetallic sulphides or cobalt crusts in the Area, including estimation of the composition, sizes and distributions of deposits of polymetallic sulphides or cobalt crusts and their economic values, without any exclusive rights

For polymetallic sulphides or cobalt crusts the exploration area shall consist of contiguous blocks.

It was noted that, compared to the regulations on prospecting and exploration for polymetallic nodules, the draft regulations on polymetallic sulphides and cobalt rich crusts contained additional provisions aimed at the protection and preservation of the marine environment.

The contractor shall have the exclusive right to explore an area covered by a plan of work for exploration in respect of polymetallic sulphides or cobalt crusts.

The Authority reserves the right to enter into contracts with respect to resources other than (polymetallic sulphides) (cobalt crusts) with third parties in the area covered by this contract.

The International Seabed Authority is currently involved in the development of a legal regime for the prospecting and exploration of polymetallic sulphides and cobalt rich crusts.
