BERKELEY It is difficult to read former US Federal Reserve Chair Ben Bernanke s new memoir, The Courage to Act, as anything other than a tragedy. Hence the necessity of something like the individual health insurance mandate of the 2010 Patient Protection and Affordable Care Act ( Obamacare ), or of biting the bullet and adopting a single payer system for financing health care. Either way, America needs to gets something comparable to other OECD countries value out of its enormous health care expenditures.

In the new Congress' first couple of weeks, the House passed a bill scaling back the Dodd Frank financial reform act. Numerous proposals are pending to undo significant parts of the Patient Protection and Affordable Care Act, Obama's signature health insurance program (if the Supreme Court does not do the job later this year).

The United States Affordable Care Act, which entered into force this year, contains further variants on the idea of government as a catalyst, including incentives to reward health care systems that improve outcomes and reduce costs. The incentives have spurred a number of state level experiments in Medicaid (America s health insurance program for the poor) through waivers of the standard rules.

The biggest banks now account for an even larger share of the financial sector after benefiting from a government rescue, while efforts like the Dodd Frank Act to legislate more constraints on banks have been lobbied into shadows of their original selves. The elite, whether in government or big business, seems to look after itself and no one else.

There are also inconsistencies between the US and the EU in derivatives market reform, which the Financial Stability Board has warned could undermine the objectives, set out by the G 20, of greater standardization of contracts and enhanced transparency. And, whereas the Basel standards continue to refer extensively to credit ratings as the basis for assessing the creditworthiness of borrowers, the Dodd Frank Act in the US moves away from reliance on ratings.

In his first two years in office, when his Democratic Party controlled both houses of Congress, he took numerous steps to stem the worst economic downturn since the Great Depression. Likewise, he got his landmark health care reform, the Patient Protection and Affordable Care Act, passed.
