Financial Regulators Fine Mess

Regulators, recognizing the risks of allowing financial deglobalization to accelerate, have been seeking better means of handling the failure of huge global banks. If banks can be wound up easily when things go wrong, with losses equitably distributed, regulators can more easily allow them to continue to operate globally and efficiently.

The soundness and credibility of insolvency laws and director and officer practices are central to the efforts of governments and regulators to enhance the operation of the global financial system.

CAMBRIDGE When the financial crisis of 2008 hit, many shocked critics asked why markets, regulators, and financial experts failed to see it coming. Today, one might ask the same question about the global economy s vulnerability to cyber attack.

The school solution, agreed at the Financial Stability Board in Basel, is that global regulators should clearly identify systemically significant banks and impose tougher regulations on them, with more intensive supervision and higher capital ratios. That has been done.

Banks are overseen by a home regulator in their country of incorporation, and by a series of host regulators where they operate. Home regulators and lenders of last resort are increasingly worried about their potential exposure to losses in banks overseas operations.

To be sure, markets might move those transactions from France and from French financial institutions, and, if the regulators erred because the business was profitable and not destabilizing French institutions would lose out. In these circumstances, more complicated regulations merely mean more billable hours for lawyers, more income for regulators switching sides, and more profits for derivatives traders.
