In 1985 a new petition for nullification of the act on grounds of unconstitutionality was attempted.

The lack of progress in the establishment of a Truth and Reconciliation Commission was due to the nullification of the relevant decree.

In response to this petition, the Council of State declared on 30 March 1971 that it lacked the competence to decide on nullification of the 1952 note.

The Government of Colombia did not make any subsequent declaration questioning the act however, two petitions for nullification were presented to the Council of State in 1971 and 1992, with differing results.

The performance of the act in this case merits additional commentary in the light of the situation created by a petition to the Council of State of Colombia for nullification of the note.

The Ministry of Foreign Affairs based this objection on the fact that the act whose nullification is requested is a legal act of an international character which transcends domestic law and is governed by the rules of international conventional or customary law .

So, in essence, what is happening in Thailand is an attempted nullification of democracy by the opposition and the country s entrenched elite. Unable to compete successfully with Thaksin for votes, they now want to dilute Thai democracy in order to prevent the electorate from ever again choosing a government that goes against their will.
