Torture, beating, and other mistreatment of Uzbek detainees are widespread. Sometimes people who are taken into Uzbek custody are never heard from again.

Two issues were raised with respect to the Uzbek community in Kyrgyzstan.

An important element in ensuring the success of Uzbek Afghan cooperation is the fact that the relevant Uzbek agencies have 30 years of experience in working in Afghanistan in the area of economic development.

According to article 14, Uzbek nationals cannot wear religious dress in public places.

In defence, Turkey invoked assurances concerning the two applicants given by the Uzbek authorities.

The author of the communication is Raihon Hudoyberganova, an Uzbek national born in 1978.

He had recently received a note from the Uzbek authorities but had not yet been able to analyse it properly.

The Uzbek people's developed sense of tolerance is an integral part of the culture in the country as it is today.

It also welcomed the role played by UNHCR and the Governments of Kyrgyzstan and Romania in satisfactorily resolving the threatened return of Uzbek refugees.

It recommends, in particular, that the same treatment be granted to refugees of Turkmen, Uzbek, or other ethnic origin such as those coming from Afghanistan.

She submits the communication on behalf of her son, Vazgen Arutyuniantz, also an Uzbek citizen, born 1977, currently imprisoned in the city of Andijan in Uzbekistan.

However, the medical certificates obtained in the Turkish case had been issued by Uzbek military doctors working in the prisons where the applicants in that case were detained.

His delegation had invited the Uzbek delegation to engage with it in discussions of the draft resolution and stood ready to work with Uzbekistan to promote full respect for human rights.

The Committee should address substance, urge the Government of Uzbekistan to implement its international commitments and make clear to Uzbek civil society that the international community was aware of its plight.

After the violent events in Andijan in May 2005, UNHCR had moved most of the 450 Uzbek asylum seekers from Kyrgyzstan to Romania to ensure their protection and for future resettlement.

He was found guilty, with four other persons (including his brother E. Zhurin) of having committed different crimes including murders in Russia and the then Uzbek Soviet Socialist Republic between 1984 and 1988.

However, Uzbekistan's readiness to cooperate on the issue of human rights was ignored, while bilateral contacts were used to ensure the adoption of the draft resolution, whose text had not been shown to the Uzbek delegation beforehand.

4.2 The State party submits that the preliminary investigation into the crimes for which Mr. Arutyuniantz was convicted was conducted in accordance with the Uzbek Criminal Procedure Code, and that all charges and evidence were thoroughly assessed.

Based on the growing legal foundation for Uzbek Afghan cooperation, our country is providing assistance to the Afghan people in reconstructing and building its infrastructure, including road and transportation lines, water management and energy facilities, and irrigation structures.

The State party merely contends that Mr. Arutyuniantz was tried and convicted in compliance with Uzbek laws, that the charges and evidence were thoroughly assessed, that his guilt was proved, and that the communication is both inadmissible and without merit.

During his visit to Kyrgyzstan, he had also had the opportunity to speak with four Uzbek citizens who had been detained in the south of the country after fleeing the tragic events that had occurred in Andijan in May 2005.

In particular, it is concerned about the reported closure of minority cultural institutions and of numerous schools teaching in minority languages, in particular Uzbek, Russian, Kazakh and Armenian languages, and the reduced possibilities for the use of minority languages in the media (arts. 2 and 5).

Since independence, the following have been translated into Uzbek and published the Koran, the Inzhil (two books of the Old Testament Genesis and Psalms and 27 books of the New Testament) and parts of the Old Testament (Song of Solomon, Ecclesiastes, 1 4 Kings, Daniel, Ruth, John and Esther).

Members of the Uzbek security service visited me here at Guantánamo and accused me of being a member of the Islamic Movement of Uzbekistan. When I told them that I didn t know anything about this group, they warned that once I was back in their custody, they would make me cooperate.

An appeal was made to the Government of Kyrgyzstan to grant refugee status to asylum seekers who had entered neutral territory after 16 May to encourage local Uzbek community leaders to assist refugee camp residents and to invite an OHCHR mission to meet with the refugees and take their testimonies.

The scale of the deaths in Andijan and the subsequent deterioration in the human rights situation in Uzbekistan as well as the continued refusal by the Uzbek authorities to cooperate with and address the concerns of the international community, including the United Nations, required the General Assembly to address the issue.

All of the 80 different ethnic groups in the country, including the 14 per cent of the population who were Uzbek, had the same rights and obligations under the Constitution 10 per cent of the deputies in parliament were Uzbeks, they were integrated into economic life, and radio and television broadcast in their language.

The Ministry of Justice, the Supreme Court, the Public Prosecutor's Office and the Ministry of Internal Affairs, together with the National News Agency, the Public Television and Radio Company of Uzbekistan and Uzbek press and news agencies, shall develop and implement a set of measures to organize a mass public information campaign on the abolition of the death penalty.

Against the background of the assurances obtained by Turkey and the medical reports from the doctors in the Uzbek prisons in which the applicants were held, the Court found that it was not able to conclude that substantial grounds existed at the relevant date for believing that the applicants faced a real risk of treatment proscribed by article 3 of the European Convention.

The acquisition, possession, export and import of firearms are monitored by the Uzbek law enforcement agencies under Presidential Decree No. 1871 of 10 October 1997 on additional measures to stimulate the export of goods (works, services) and resolution No. 137 of the Cabinet of Ministers of 31 March 1998 on additional measures to liberalize foreign trade operations in the Republic of Uzbekistan.

While taking note of reports of international human rights organizations denouncing an administrative practice of torture and other forms of ill treatment of political dissidents and the Uzbek regime's repressive policy towards such dissidents, the Court furthermore stated that, although those findings described the general situation in Uzbekistan, they did not support the specific allegations made by the applicants in the case and required corroboration by other evidence.
