(c) In cases not falling under subparagraphs (a) and (b), the reservation is incompatible with the object and purpose of the treaty.

For the purposes of guideline 3.1, the expression specified reservations means reservations that are expressly authorized by the treaty to specific provisions and which meet conditions specified by the treaty.

It should also be made clear that if a treaty prohibited reservations to specific provisions or certain types of reservations, only those reservations were expressly prohibited.

Although some States parties have withdrawn reservations to those articles, the Committee is particularly concerned at the number and extent of reservations entered to those articles.

A reservation expressly prohibited by a treaty could not be considered valid on the pretext that it was compatible with the object and purpose of the treaty the same was true of a specified reservation expressly authorized by the treaty, such reservations were automatically valid and were not subject to the text of compatibility with the object and purpose of the treaty.

Saving clause

The second case was more frequent a treaty might prohibit reservations to specific provisions of the treaty or prohibit categories of reservations, which was much more complicated.

(f) Viet Nam, on 4 November 1997, entered a reservation on article 6 (Extradition) as a whole.

With regard to draft guideline 3.1.4, the view was expressed that the Commission should opt for clearer wording affirming that reservations were subject to the criterion of compatibility with the object and purpose of the treaty if there was a general authorization or if the treaty did not contain any provisions on reservations.

However, the Working Group decided to retain the provision (A CN.9 571, paragraphs 127 and 128).

Under article 29 of the Constitution, citizens have the right to conserve their own language and script.
