Europe Should Dump Anti Dumping

The abusive use of anti dumping measures was a matter of concern to his delegation.

Subsidies by rich nations foster over production and thus lead to dumping food on local markets at prices below production.

The abuse of anti dumping measures and the use of discriminatory trade actions were among the actions to be rejected.

In other words, producers sell at prices that are below cost, because, having already built the factories, they would lose even more money if they charged above the competitive market price or shut down production altogether. But findings of dumping into foreign markets surely warrant some response, no? Actually, no.

Conversely, the presence of quotas or countervailing duties affecting the potential host country is discouraging for investors.

In that connection, industrial countries participating in the Doha Round must put an end to their unfair subsidies and dumping practices.

For example, in the case of exports from the Russian Federation, anti dumping procedures had become a serious distortion and obstacle to steel exports.

Concern was also expressed that textile quotas may be replaced by anti dumping measures and other NTB measures.

The developed countries should avoid resorting to anti dumping and countervailing duties to unfairly target developing country exports.

With respect to efforts aimed at protecting competition at the level of external trade, he drew attention to Mexico s important anti dumping procedures.

The rules negotiations cover anti dumping, subsidies and countervailing measures, including fisheries subsidies, and regional trade agreements.

Simply put, anti dumping measures, such as the US and EU tariffs against Chinese solar panels, are a means of reducing, not fostering, competition. So, if predatory pricing is not the producers motive for selling below cost in these cases, what is?

The clearest example is anti dumping, a ploy used whenever a country begins to succeed in competing with specific products.

In cases where anti dumping, countervailing or safeguard measures are used against imported goods according to the provisions of related laws or administrative regulations, the application of tariff rate shall be determined in line with the relevant provisions of the Regulations of the People's Republic of China on Anti dumping, Regulations of the People's Republic of China on Countervailing Measures, and the Regulations of the People's Republic of China on Safeguard Measures.

With respect to goods from those countries, no quantitative restrictions on imports are applied, nor have we introduced anti dumping, compensatory or special protective measures.

What we see is that, in fact, the teams that are prosocial sell more stuff than the teams that only got money for themselves.

The international community could do its part by removing non tariff barriers, ending abusive anti dumping measures, granting debt relief and increasing official development assistance.

Anti dumping proceedings have been criticized on grounds of inadequate examinations as to whether imported and domestic products fall, in fact, within the same quality segment, lax determinations of causality between dumping and injury, neglect of consumer interests and the legal possibility to file new complaints whenever earlier complaints regarding the same import product have been unsuccessful.

For example, as of mid 1997, some 150 anti dumping measures were in force in the European Union (EU) and about 300 in the United States of America.23 Moreover, developing countries similarly have started to make greater use of such trade remedies .24 Indeed, as of 1996, developing countries accounted for over half the anti dumping actions reported to the World Trade Organization.25

Furthermore, the export was a normal commercial transaction, not dumping in the trade sense nor was it dumping in the sense used in the wastes context, since the batteries were not subject to disposal but rather recycled as an input into industrial process in the Philippines.
