Plan of action for regulating and protecting the prostitution sector

With respect to trafficking in persons, the law also made provision for protecting those in need and sheltering victims.

II. SURVEY OF THE EXTENT TO WHICH CHILDREN ARE PROTECTED

In order to ensure adequate protection for the victims of trafficking, a Provisional Instruction has been issued for treatment of victims of trafficking with the basic aim to prevent discrimination and protect the victims (women and girls) who are the most usual victims of this organized crime.

It would be better to use the term trafficking in order to protect the dignity and best interests of the child.

The experts called upon Governments to take decisive steps to ensure sufficient protection of children from becoming victims of illicit trafficking.

The State party should adopt specific anti trafficking legislation, including for the protection of the human rights of victims, and actively investigate and prosecute trafficking offences.

Paradoxically, this would have the effect of immediately protecting the vendor rather than the other contracting partner.

2. States Parties shall adopt special measures in order to protect children specially vulnerable to sale of children, child prostitution and child pornography.

A normative framework had been established for the protection of witnesses, including special measures for the protection of minors, and the law also punished legal entities facilitating prostitution.

Deficiencies in the registration system lead to children being deprived of basic safeguards for the promotion and protection of their rights, including in the areas of child trafficking, abduction, sale and maltreatment, abuse or neglect.

The provisions of the Convention clearly state the child apos s right to protection against all forms of sexual exploitation including sale of children, child prostitution and child pornography (art. 34) they also include protection from sexual abuse (art. 19).

States Parties in accordance with international norms for the protection of children promote education, information and public awareness of the effects of the sale of children, child pornography and child prostitution.

Intergovernmental agreements to guarantee the voluntary and safe return of women and ensure that protection and support is provided to trafficked women awaiting repatriation proceedings should be elaborated.

Strategies to address these root factors should be facilitated and supported by the United Nations and its Member States, and at the same time measures should be strengthened to discourage traffickers, protect those who are vulnerable to trafficking, offer legal, physical and psychological protection and empowerment to victims of trafficking, and address the futures of women and children who have been victims of trafficking.

Priority should be given to domestic and international efforts to preserve and protect the cultural patrimony of Afghanistan and prevent looting and illegal trafficking.

In order to provide adequate protection to victims of trafficking, a Protocol has been signed on cooperation with NGO, which specifies the obligation of the competent bodies (primarily the police) to provide adequate support legal aid, medical protection, etc., to persons suspected to be victims of trafficking.

It was also striving to provide means of livelihood and protection to affected women, to keep them from falling victim to trafficking and sexual exploitation.
