The provision, which simply referred the reader to articles 42 to 45 of the Vienna Convention, had proved largely uncontroversial.

76. As regards Issue 4 (Reference base and yardstick), Prof. Melander made reference to the so called Martens clause. Without any doubt, that clause was of importance.

She also pointed out that occasionally it might prove difficult to finalize the text of an article without consideration of other closely linked articles which should then be considered together.
