Some female health workers were allowed to resume work in conditions outlined in a decree contained in appendix II to this report.

If the work is remunerated on a piecemeal basis, the official daily wage must be its equivalent (article 28 of Act No. 2851).

When the order has been adopted the requirements for admission to vocational training and education will be met if the student has entered into a work practice agreement and meets the specific admission requirements laid down in the orders concerning the training and education concerned.

For women, the working day is not to exceed eight hours, 45 hours in a week (Article 5, Act No. 2851).

175. In relation to article 5 (e) (i) of the Convention, the situation of migrant workers is of concern, especially in relation to access to work and equitable conditions of employment.

A longer employment period (as a rule at least 15 years) in particular conditions This concerns workers employed in particularly unhealthy conditions, in particularly arduous jobs or in conditions requiring high psychophysical efficiency for reasons of personal safety or environmental safety.

Under the current scheme, conditions were established for mobility payments to staff moving to headquarters duty stations that were more stringent than conditions defined for staff mobility in the field.

According to article 1 of the Act it is unlawful to hire a worker for less remuneration or on worse conditions than he would have been entitled to as a member of the respective trade union.

For the purpose of the hardship scheme, hardship categorization assesses the overall quality of life at a duty station.

Articles 12 and 17 of the Supreme Decree of 25 June 1921 also prohibit women from engaging in underground, mining and quarry work.

200. Concerning working conditions, the Labour Code contains provisions on health and safety in the workplace.

The Vietnamese Government has adopted a number legal documents on education, including Decree No 43 2000 ND CP on 30 August 2000 guiding the implementation of the Education Law, Decree Number 35 2001 ND CP on 9 July 2001 on policies towards teachers, managing staff in specialized schools and in areas with particularly difficult socio economic conditions and Decree No 88 2001 ND CP on 22 November 2001 on universalization of elementary education.

The allowance is payable even when the mother has engaged in salaried labour (articles 22 and 30 of Decree Law No. 22482 and Supreme Decree No. 029 84 PCM).

A permanent appointment can be terminated under staff regulation 9.1(a) if the services of the individual concerned have proved unsatisfactory.

The lifting of these measures may be ordered by the examining magistrate under the conditions provided by law.
