The company had been the highest of three bidders for the contract, and the lowest bid was 28,800.

Bidders must be aware how a public institution will assess bids.

The most common procedure was the tendering method (adjudication), in which the contract was awarded to the tenderer offering the lowest price.

16. The Advisory Committee points out that under financial rule 110.21 quot contracts shall be awarded to the lowest acceptable bidder quot .

If its is intended that a bidder from a punctual Member State may be preferred over bidders from Member States in arrears (even if these offer better quality for better price), it would seem necessary to establish a range of price variation above the lowest acceptable bidder within which the decisive criterion would be the nationality of the bidder (for example, a higher bidder may be selected in no more than x above the lowest acceptable bidder).

Consequently, the winning bid may be simply an established increment below the second lowest bid rather than the lowest responsible and responsive bid.

However, as it cannot generally be known who would have submitted the next best bid had the auction continued (since bidders may withdraw without submitting their best bid, if other bidders bid too low a price and it may not therefore be possible to identify the second best bidder), negotiations would be required with all other bidders.

Applying the principle of functional equivalence to the electronic submission of tenders, electronic tenders require the same legal value as tenders submitted in writing, signed and in a sealed envelope.

This rule would be part of every Request for Proposal so that no bidder could complain.

ERAs may be based solely on prices when the contract is awarded to the lowest price or on prices and or on the new values of the features of the tender indicated in the specification, if the contract is to be awarded to the most economically advantageous tender.
