Mr. Al Habil was not allowed to appoint a defence lawyer.

(b) Nevertheless, the questioning took place in the presence not of a lawyer chosen by the accused, but of assigned counsel

At present, the Tribunal has 43 counsel (including co counsels) from 15 countries assigned by the Tribunal.

Second allegation Gerardo Bermúdez Sánchez was denied his own choice of counsel, pressure having been brought to bear on the lawyer appointed, forcing her later to leave the country.

It further appears that quot five months later the situation had not altered quot and that then the above mentioned counsel had been assigned.

In this context, he submits that, prior to the preliminary inquiry, he was assigned a lawyer who, however, did not even attend the hearing.

However, owing to some unexplained family squabbles, the issue of legal representatives had become a problem, as some members of the family had decided to appoint another counsel, in the person of Chief Rotimi Williams, to replace the one already handling the case, who, as indicated had been appointed at the instance of Chief Abiola.

On 20 May 2005, the Registrar withdrew the assigned lead counsel.

Intensive work was carried out on the new system of remunerating assigned counsel.

Once that is done, the responsibility for the conduct of the case rests with counsel, and errors of judgement or other failings cannot be attributed to the State party.

8.3 Counsel reiterates that the State party violated article 14, paragraph 3 (d), because it appointed incompetent legal aid counsel to assist the author.

In accordance with the minimum guarantees afforded to an accused in the interest of justice, 2 duty counsels were assigned to represent indigent accused persons in the reporting period, in addition to 10 lead counsels and 9 co counsels. This brought the total number of counsels currently assigned by the Tribunal to 88 5 duty counsels, 53 lead counsels and 30 co counsels.

Furthermore, the authors failed to indicate how their attorneys would have acted against their instructions, and there was no indication that Mr. Morrison apos s attorney or junior counsel representing Mr. Graham had acted negligently in the discharge of their professional duties.

Three or four months later, a second lawyer agreed to represent him on a legal aid assignment.

8.3 As regards the author apos s representation at trial, the State party asserts that the duty of the State party is to appoint competent counsel to represent clients in need of legal aid and not to obstruct counsel in the performance of his duties.

The authors have argued that they were not informed by the Court that a legal aid counsel had been appointed for them and that appointed counsel factually withdrew the appeal without having consulted or informed them.

If the defendant wants to defend himself or has no money to pay for a lawyer, the Court will instruct the Bar Association to appoint a lawyer.

The author contends that he did not meet with the lawyer assigned to him until the day before the trial.

89. To date, the Tribunal has no unassigned lawyers.

Counsel reiterates that the authors apos representative on appeal was appointed without the authors being informed and maintains that that amounts to a violation of article 14 of the Covenant.

22. The Government apos s claim that the failure of the lawyer to participate in her client apos s defence did not leave Bermúdez without counsel, as he had four lawyers, is unacceptable under article 144 of the Code of Penal Procedure, an accused person is entitled to only one lawyer, who may designate an alternate under his responsibility.

The State party concludes from the above that the authors had ample opportunity to retain counsel of their choice and that the appointment of legal aid counsel in the specific circumstances did not constitute a breach of the Covenant.

The trial resumed on 11 April 2005, following the assignment of a new lead counsel.

Although Yugoslav law does not oblige the court to appoint a lawyer in cases where offences carry a maximum punishment of five years apos imprisonment, the presiding judge nevertheless proceeded to arrange for him to choose a lawyer on the spot from among the 13 legal counsel present.

The author asked his legal aid lawyer to obtain his medical records from the hospital, but the lawyer allegedly refused to do so.

If a warrant of arrest of a juvenile is executed, he or she must be appointed defence counsel.

These include (a) assignment, where necessary, of a co counsel to assist the chief counsel in carrying out his work (b) authorization to use the services of investigators, research assistants and experts, and so forth.

The author contends that the legal aid lawyer who was assigned to his case asked him for money, and since he did not have any, never visited him again to discuss the case.

The Committee concludes that the author has not substantiated, for purposes of admissibility, that the removal of his lawyer from the trial was unlawful or arbitrary, that counsel was appointed against the author's will, or that he was unqualified to provide effective legal representation.

An accused person may retain a lawyer of his or her choice.

The source further reports that Mr. Al Tamimi has not been allowed to contact or to appoint a defence lawyer.

The two men were defended by court appointed lawyers because their families were afraid to appoint their own lawyers.

The state bar association will determine the fee.

A Committee of Lawyers had been designated to provide free legal assistance to the victims of crimes committed during the military coup.

Bar associations were duty bound to designate a defence counsellor for those who could not afford to assign one for them and they should establish legal assistance institutes in each region.

Mr. Al Qaid has not been authorized to appoint a defence lawyer, nor given an opportunity to be heard by a judicial authority.

10.3 As regards the author apos s claims concerning his representation at the preliminary enquiry and at the trial, the Committee notes that it is uncontested that the legal aid lawyer assigned to the author did not attend the preliminary enquiry, that the author was consequently represented by counsel of his co accused with whom he had a conflict of interest, and that the author met his lawyer only one day before the commencement of the trial.

He had not met with the lawyer in person his mother appeared to be the one giving instructions to the lawyer.

Three of the defendants were represented by a Republika Srpska lawyer who was appointed only nine days before the trial.

Such classification under CIPA allegedly had a negative impact on the right to defence, as the defendants were thereby limited in the choice of their lawyers to lawyers approved by the Government, and both lawyers' and defendants' access to the evidence was limited.

However, when the lawyer showed the written authorization from the authorities, the guard reportedly informed the lawyer that he had received instructions from the investigative judge that any discussion between lawyer and client was forbidden.
