43. Since the minimum wage is guaranteed by the Constitution (art. 48, para. 5) and by the minimum wage system provided in the Labour Code (art. 244, para. 1), the minimum wage system has the force of law.

42. The right to a minimum wage is a fundamental constitutional right of workers and employees (art. 48, para. 5, of the Constitution).

The Chairman said that the difference between the proposed disconnection clause and the final provisions was that the latter were all taken from established precedents.
