There are approximately 120 Palestinian women prisoners of whom 11 are in administrative detention that is, held without charge or trial.

The Committee found a violation of this provision in case No. 617 1995 (Finn v. Jamaica) (two years and five months of pre trial detention), 672 1995 (Smart v. Trinidad and Tobago) (over two years of pre trial detention), 705 1996 (D. Taylor v. Jamaica) (27 months of pre trial detention),732 1997 (Whyte v. Jamaica) (three years of pre trial detention) and 733 1997 (Perkins v. Jamaica) (one year and nine months of pre trial detention).

Since then he has reportedly been detained without charge or trial.

Some have been detained as long as for 12 years without trial.

Released without charge or trial

The Committee remains concerned that despite the reduction in the number of persons held in administrative detention on security grounds, persons may still be held for long and apparently indefinite periods of time in custody without trial.

C. Pre trial detention and conditions of detention

It was raised on several occasions that this law was used to detain and imprison people without trial.

Minors are often arrested and can either remain in prison without trial for many years, or be sentenced to very heavy terms of between 10 and 20 years, without having had the assistance of a lawyer during their trial.

If they have been tried, we would appreciate the opportunity to interview those who are still in custody, as well as the judges and prosecutors involved in the trial.

8. The Working Group finally notes that Mammo Wolde has been detained since 1992 without charge or trial.

As empirical research in many countries has shown that defendants who are not detained pending trial have significantly better chances to obtain an acquittal than those detained pending trial, the bail system deepens further the disadvantages that the poor and marginalized face in the enjoyment of the right to a fair trial on an equal footing.

Although most staff members were released without charge or trial after relatively short periods of detention, the number of staff members who remained in detention at the close of the reporting period increased from four on 30 June 1997 to nine on 30 June 1998.

Minors may be imprisoned either during the course of the investigation, subject to an order for pre trial detention, or as a form of penalty once they have been sentenced.

In a few serious cases, such as a fatal shooting in the Artibonite region in July, a prosecutor placed a police officer in pre trial prison detention after he had been detained following an internal police investigation.

According to the detainees, the two who were tried in Adura im were sentenced to three and a half months in prison while the third, who was tried in Beit El, was sentenced to 30 months.

(h) A system of regular visits to all places of detention (police custody, pre trial detention and post conviction imprisonment) should be put in place.

Two Trial Chambers were running three trials full time, nine indictees were in detention and the Court's work should be completed by early 2007.

(f) Improving the juvenile justice system, particularly by complementing the newly created juvenile court with facilities for the separate pre trial detention and post trial incarceration (if necessary) of minors, in line with the Convention on the Rights of the Child.

Trials of the eleven detainees awaiting trial will require about 682 trial days.

Over 600 of those imprisoned are in administrative detention, that is, they are persons held without trial.

These include 92 detainees convicted of various minor crimes and given sentences ranging from three to six months' imprisonment, some of whom described receiving beatings during arrest and in pre trial detention and being denied basic fair trial guarantees.

Mr. Zhang was sentenced without trial he was arrested without a warrant he was detained without charges for 15 days and he was denied access to a lawyer and to his family for 15 days.

Of this number, some 120 are women. Over 300 children under the age of 18 are in Israeli detention centres. Forty per cent of them have been sentenced to imprisonment and 60 per cent are in pre trial detention.

66. If the term detention were to apply to pre trial detention alone, then it would follow that the Declaration does not condemn arbitrary imprisonment pursuant to a trial of whatever nature.

In this regard, it underlines that, in accordance with the principle of presumption of innocence, pre trial detention should not be mandatory.

Furthermore, principle 38 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment provides that a person detained on a criminal charge shall be entitled to trial within a reasonable time or to release pending trial .

28. MICIVIH worked closely with judicial and prison officials to expedite proceedings on the many cases of detainees held for long periods without trial.

291. On 28 April, the security authorities extended by four months the detention of the longest serving administrative detainee, Ussama Birham, who is reported to have been held in Israel without trial since September 1993.

(b) Detained without charges and sentenced without trial by the RTL Commission to two years of re education through labour

23. The Government of Rwanda continues to hold without trial five UNICEF national staff members.

These deplorable conditions, combined with severe overcrowding and excessive periods of imprisonment (many have been detained for up to four years without trial) have caused an increase in diseases (such as tuberculosis), and in overall prison mortality rates.

10. It appears from the facts as described above that the nine above mentioned persons were arrested on 22 January 1996 and have since that date been detained without charge or trial.

Article 38 of the Constitution of Angola provides Any citizen subjected to preventive detention shall be taken before a competent judge to legalize the detention and be tried within the period provided for by law or released.

It is also learnt that a total of 70,000 people are being detained in Nigeria today either upon conviction, remand or without trial.

No visits were made to detained staff members in Jordan.

(b) With regard to Hussainu Njai and nine others, their continued detention beyond the 90 day legal deadline for custody, without being brought before a judge, as provided for by the Gambian law, also cannot be linked to any legal basis.

179. Act No. 26295 established the National Register of Detainees and Persons Sentenced to Custodial Sentences, the purpose of which is to secure the human rights of detainees and of persons sentenced to imprisonment.
