The judgement reads as follows The crime committed is statutory rape.

The Combating of Rape Act provides that no marriage or other relationship will be a defense to a charge of rape.

The previous law on rape in Namibia contributed to marital rape (a man raping his wife) and rape of people other than women, because these crimes were legally defined not as rape, but as indecent assault (Iipinge and LeBeau 1997 80).

Legislation should be passed to make marital rape a criminal offence.
