Section 26A of the Legal Aid Ordinance provides that a legal aid applicant who has been refused legal aid for an appeal to the Court of Final Appeal may seek a review of such refusal.

The author's first lawyer declared that applying for amparo had been proposed, but he had instead submitted an application for judicial review which had been declared inadmissible.

4.3 In relation to the authors' application for registration, the State party notes that the first two applications did not comply with legal requirements. In relation to the third application, the C.R.N.

Applicants must also satisfy all other relevant legal requirements, including those regarding health and character.

Legal aid applications

As a result, the Court was asked to declare certain regulations of no force and effect for the applicants in advance of the constitutional validity of the legislative scheme being reviewed.

Federal law requires that all asylum claims be adjudicated on the particular facts and circumstances of the claim, and such a bar violates that principle, the friend of the court brief said.

The application has been served on the solicitors for the claimants.

The law also provides that a court on application for a legal remedy (appeal) shall hear the parties and receive the prosecutor's proposal before declaring a claim inadmissible.

Had their application been turned down, the complainants could have requested leave to apply for judicial review of the decision.

A recent amendment to the Act concerns refugees, while disallowing any claims to refugee status in the Cook Islands.

They note that in the application to the Constitutional Court for amparo they claimed that the lack of a verbatim record resulted in an absence of legal guarantees.

2.2 The author did not submit an application for amparo (enforcement of constitutional rights) with the Constitutional Court, considering that it would serve no purpose in view of the Court's repeated denial of applications for amparo for the purpose of reviewing facts established in the judgements of the ordinary courts.

2.3 The author lodged an amparo application before the Constitutional Court, which was rejected on 29 January 1997.

In his view, requiring the authors to have pursued this avenue on merits review to the RRT and thereafter in the courts by judicial review was rejected in Winata and should again be rejected.

For other offences, provided the applicant passes the means test, a judge may grant legal aid notwithstanding that legal aid has been refused on merits by the Director.

3.3 The author did not make any application to the Constitutional Court for amparo.

In counsel's view, the complainant's statement to the court and the court's rejection of his request constitute a further clear indication that he had been subjected to torture.

However, the author failed to lodge an amparo.

A motion for leave to appeal to the Supreme Court of Canada was denied.

The law clearly provides for applications for amparo proceedings from individuals who consider their fundamental rights to have been violated.

The Law On Civil Service, in its turn, provides the procedure for testing the suitability of an applicant for the office of a civil servant and the requirements that do not include discriminatory demands.

The author filed an application for review of that decision, an application that was rejected by the court on 7 July 1998.

Once the applicant meets all the legal requirements, the head of the Ministry submits it to the Federal Government for consideration together with his opinion on the establishment of the factory in question.

His petition for special leave to appeal to the Judicial Committee of the Privy Council was dismissed on 26 May 1988.

Nevertheless, the Court decided not to ask the petitioners to pay the costs of the legal action. (Ha aretz, 18 September)

The author then applied to the Supreme Court for a declaration that a judicial error had been committed.

16. The requested State Party may request additional information when it appears necessary for the execution of the request in accordance with its domestic law or when it can facilitate such execution.

According to the State party, the author should have submitted an application for amparo to the Constitutional Court.

Even though his lawyer subsequently applied for habeas corpus to the Supreme Court, this application was never adjudicated.

He reiterated that Costa Rica is seeking no more or no fewer rights than are provided for under relevant legal instruments .

The Model Provisions could require that the application be filed within a specified time limit from the date of request for provisional relief.

The requesting country's laws need not be infringed for it to make such a request it suffices that its important interests are affected.
