Income or other benefits derived from proceeds of crime, from property into which proceeds of crime have been transformed or converted or from property with which proceeds of crime have been intermingled shall also be liable to the measures referred to in this article, in the same manner and to the same extent as proceeds of crime.

Laundering of proceeds of crime

Disposal of confiscated proceeds of crime or property

(v) Disposal of confiscated proceeds of crime (article 14)

The Party transferring the proceeds of crime or property assumes no liability or responsibility for the proceeds of crime or property once they have been transferred and relinquishes all right or title to and interest in the transferred proceeds of crime or property.

2. On receipt of a request for sharing confiscated proceeds of crime or property made in accordance with the provisions of this article, the Party where confiscated proceeds of crime or property are located shall share with the other Party such proceeds of crime or property, as set out in article 3 of this Agreement.

Receiving, which was defined as the knowing possession or enjoyment of proceeds of crime or of money laundered from drug trafficking by an individual, was also a crime under articles 508 510 and article 446 of the Penal Code.

The idea was principally to study how to implement the criminalization provisions relating to laundering the proceeds of crime, corruption and participation in organized criminal gangs.

Assistance appears to be needed with the formulation of the four offences established by the Organized Crime Convention, in particular the offence of participation in an organized criminal group extradition and mutual legal assistance and the provisions governing the confiscation, seizure and disposal of proceeds of crime or other property.

29. In the fight against crime and drug trafficking, a regional and international perspective was needed, and Benin welcomed the recent strengthening of the activities of the United Nations African Institute for the Prevention of Crime and the Treatment of Offenders (UNAFRI).
