For example, the legal assessment of the official policy of apartheid pursued by the former South African authorities was not called into question (in any event, not on the part of States signatories of the International Convention on the Suppression and Punishment of the Crime of Apartheid).

What about the civil rights laws and integration?

69. The Committee notes that Zimbabwe, prior to 1980, had a non democratic regime where legislation and policies adopted and implemented by the authorities led to racial segregation and discrimination in society.

The reference to apartheid may have been directed exclusively to South Africa, but the article as adopted prohibits all forms of racial segregation in all countries.

49. By resolution 8 (XXIII) of 16 March 1967, the Commission on Human Rights decided to give annual consideration to the item entitled Question of violations of human rights and fundamental freedoms, including policies of racial discrimination and segregation and of apartheid, in all countries, with particular reference to colonial and other dependent countries and territories .

604. With reference to article 3 of the Convention, members of the Committee acknowledged the leading role of Nigeria in the struggle against apartheid and in its dismantling.

The type of racial discrimination, similar to what was practiced in South Africa when the policy of apartheid was not yet dismantled, has never officially or factually existed in the Philippines, neither in a systemic nor formal nor intermittent nor isolated manner.

II. THE CRIMINAL JUSTICE SYSTEM AND THE LEGACY

That position had been reflected in their denunciation of apartheid, and they considered its demise as one of the greatest accomplishments of the international community, and particularly of the United Nations, in the struggle to eliminate racism and racial discrimination.
