The sphere of application encompasses all the forms of restriction of competition in other words all economic behaviour which can have an effect on competition.

Many countries had now adopted competition laws, and new issues were arising, such as determining the laws applicable to cross border competition cases, whether laws should aim at protecting national or international markets, and how competition authorities could cooperate and on the basis of which rules.

The competition law may not provide for sufficiently large fines or other sanctions.

7. The process of developing competition policy and law in Malawi was initiated with the First National Symposium on Competition Policy and Legislation (June 1996).

The relevance of the Intergovernmental Group of Experts on Competition Law and Policy was beyond question at the present time, and the technical cooperation mandate in that particular area had been reconfirmed by the Third United Nations Conference to Review All Aspects of the Set of Multilaterally Agreed Equitable Principles and Rules for the Control of Restrictive Business Practices, as well as by the Expert Meeting on Competition Law and Policy.

II. CONSULTATIONS ON COMPETITION LAW AND POLICY, INCLUDING THE MODEL LAW AND STUDIES RELATED

In any coordination arrangement, each Party's competition authorities will seek to conduct their enforcement activities consistently with the enforcement objectives of the other Party's competition authorities.
