In such cases, the Panel could not recommend that compensation be awarded for the unsubstantiated losses.

While some ecological impacts persist, they will vary from site to site, depending on a variety of conditions, and the degree of recovery at each site will depend on the extent of oil contamination and the nature and location of the sites.

There is one claim in this instalment where the claimant established that she owned real property in Iraq however, her claim for C7 Real Property losses fails as she did not establish the fact of loss.

However, the Board was unable to confirm that individual category B awards were supported by sufficiently independent evidence to substantiate the losses claimed.

(1) An authorized certification authority shall be liable to any person who has acted in good faith in reliance on a certificate issued by the certification authority for any loss due to defects in the registration of the certification authority, technical breakdowns or similar circumstances even if the loss is not due if the loss is due to negligence by the certification authority.

In light of the assets that may be recovered, may be put into continuous use, or the actual loss thereof may not be proved, they may not be written off.

The Commission also experienced problems in confirming the valuation of losses.

The Panel considers that irregularities in documents that support asserted losses adversely affect the loss type or loss elements to which the supporting document relates.

However, the Claim contained no evidence demonstrating that the Claimant itself actually incurred a loss by reimbursing its employee for his property loss.

Accordingly, it has made modifications to Saudi Arabia's calculations to reflect these differences.

The Panel notes that the low recovery rate is attributable to the presence of a high number of non compensable losses and the prevalence of irregular documents provided in support of apparently inflated losses.

The Panel determined, on the basis of the facts that it considered had been substantiated by each Claimant, whether the loss was eligible for compensation under the applicable rules and criteria.

In this context, some delegations welcomed the fact that the definition of damage covered both consequential economic loss and pure economic loss, including loss of income directly deriving from an economic interest in any use of the environment.

D5 (bank accounts and securities) losses

It was stressed that it was important for economic loss suffered by fishing and tourism industries to be compensable, provided that the link between the incident and the economic loss was clear and demonstrable.

As the altered death certificate was proffered in support of the claimant's C3 Death loss, the Panel recommends no compensation be awarded for that loss type.

Qasr Al Hayr East The Umayyad limestone castle of Qasr Al Hayr East is in an isolated location in the middle of the Syrian Badia, 100 kilometres northeast of Palmyra.

Where the claimant fails to provide the originals of documents that support his or her asserted losses, the Panel determines that such loss types or loss elements will not be recommended for compensation.

Iraq stated that the claimant did not provide proof of his alleged personal losses.

As the Panel sees it, the critical issue to be determined in each claim is whether the evidence provided is sufficient to show that there has been a loss of or damage to natural resources as alleged and, if so, whether such loss or damage resulted directly from Iraq's invasion and occupation of Kuwait.

On the basis of the evidence provided by the claimant, the loss is compensable under the category D methodology for D1 losses.

Based on the data submitted by Saudi Arabia, the Panel has made appropriate adjustments to Saudi Arabia's estimate of the extent of service losses and to other aspects of the claim, as indicated below.

Kuwait also states that the looting of medical and public health facilities by Iraqi forces resulted in severe damage to its public health system.

According to Saudi Arabia, the Quantification Study demonstrates that 1,397 premature deaths were due to exposure to airborne particulate matter that resulted from the invasion and occupation.

Losing money is part of a producer's job.

In the light of these irregularities, the Panel finds that the claimant has failed to prove his claim for business losses and recommends no award of compensation.

(c) No compensation shall be payable by the United Nations for loss or damages that, in the sole opinion of the Secretary General, are impossible to verify or are not directly related to the loss or damage to the premises

However, the Panel finds that submission of the banknotes alone is insufficient to prove the loss, as the Panel also requires credible evidence of loss and causation.

When recommending compensation for damage or loss that has been found to be a direct result of Iraq's invasion and occupation of Kuwait, the Panel has in every case assured itself that the applicable evidentiary requirements regarding the circumstances and amount of the damage or loss claimed have been satisfied.

The claimant will also be required to provide any available evidence to demonstrate such losses.

Loss type refers to the main categories of losses while loss elements refer to the sub categories of losses subsumed under a particular loss type.

On the basis of the evidence provided by the claimant, the loss is compensable under the category D methodology for D8 D9 (individual business) losses.

See also paragraph 15(a) of Governing Council decision 1 (S AC.26 1991 1), which provides that S uch category C' claims must be documented by appropriate evidence of the circumstances and amount of the claimed loss.

In the third F4 report, the Panel found that Saudi Arabia's estimate of the area of shoreline that is contaminated by oil was reasonable.

On the basis of the evidence provided by the claimant, the loss is compensable.

The USD 112,600,000 amount for the loss of tangible business property was re allocated as follows business general assets, loss of cash, loss of stock, loss of raw materials, pre paid expenses, loss of profits on contracts, loss of business income over five years and loss of goodwill.

Accordingly, the Panel determines that no awards for compensation are to be recommended for loss types or loss elements supported by documents containing irregularities.

(b) With the intent to cause substantial damage to property where such damage results in or is likely to result in major economic loss.

It was hard to estimate the losses in terms of jobs, economic opportunities, wasted development efforts and damage to infrastructure.

With respect to the claims for loss of tangible business property and loss of business income, the Panel finds that the evidence supports recommended awards of compensation in the respective amounts of USD 7,005 and USD 17,500.

Moreover, the Panel found that the Claimant did not submit appropriate evidence in support of its alleged loss.
