Men and women of marriageable age have the right to enter freely into marriage.

Most women presently get married at the age between 20 24, and most men get married at the age between 25 29.

Since Samoans were getting married at an older age, the Government should consider amending the marriage age to bring it in line with the Convention.

(b) The differential minimum age of marriage of women and men

Marriage will not be contracted if a prospective spouse does not confirm his or her desire to marry or if a prospective spouse is not of the age to marry or if hindrances to contracting a marriage become evident.

MINIMUM AGE FOR CONTRACTING MARRIAGE

Girls are expected to marry at a very young age, to the detriment of their education.

The legal age of marriage is set at 17 years for the girl and at 18 years for the boy.
