168. Parental leave.

139. There are two kinds of leave for raising a small child.

At the end of maternity leave, if a woman wishes so, she may be given child care leave until the child reaches the age of one and a half, with an allowance paid over that period of time.

The most important of them are the social insurance benefits for workers maternity leave and allowance, confinement allowance, child care leave and allowance, care leave and allowance.

140. Leave for feeding an infant (art. 166 of the Labour Code) can be used by mothers who do not take leave for raising a small child.

Leave may be obtained to undergo education training (training leave), to take care of children (parental leave) or for sabbatical purposes (sabbatical leave), as described below

of child care leave (of three years apos duration) to take care of a child under four years of age.

A very small percentage of fathers use parental leave.

As regards non insured persons, the allowance during the leave (parental leave only) is paid by the municipal authorities.

(a) Maternity leave, paternity leave and parental leave ensure that the mother and to some extent also the father of an infant are able to spend time with their child

Parents are permitted to make their own decision as to how they will divide up the last 10 weeks of the time they receive maternity benefit (parental leave).

At the time of pregnancy, birth, and childcare, a woman has the right to maternity leave in the duration of one straight year.

Under this legislation employees could obtain parental leave and training leave with a leave allowance of up to 80 per cent of the maximum rate of unemployment benefits.

Article 165 of the new Labor Relations Law (Official Gazette No. 62 05) regulates the leave of absence for pregnancy, giving birth and parenthood.

A woman worker taking care of a disabled child is entitled to the child care leave and allowance for a period of 72 months.

A father has the right to be granted additional parental leave of fourteen calendar days during the pregnancy leave or maternity leave of the mother or within two months after the birth of the child.

138. Prenatal and post natal leave as well as the upbringing of small children are regulated by the Labour Code.

They can take 2 weeks of leave at the same time within the first 14 weeks after the child moves in with them (paternity leave).

A parent on parental leave can receive parental benefit until the child is 11 months old, after that the parent will receive child care allowance until the child is 3 years old.

Replacement there is no requirement for the employer to recruit a replacement for a person who takes parental leave.

Amended legislation on maternity, adoptive leave, parental leave, equality, the introduction of tax individualization and reductions in the tax burden on work, the development of a childcare infrastructure and women's educational achievements had all brought about that increase.

According to the Holidays Act, in force as of 2001, a mother or father shall be granted parental leave at his or her request for raising a child of up to 3 years of age.

In connection with parental leave it is possible for the municipal authorities to supplement the allowance paid to parents on leave by an amount of up to DKr 35,000 per year.

If the parental leave of Article 165 of the Labor Relations Law is not utilized by women workers, then the father or adoptive parent of the child will use this leave.

The same protection applies as in connection with maternity leave parental leave in connection with birth, and this means a reversal of the burden of proof for the employer if the person concerned is dismissed in connection with leave.

Either the mother or the father has the right to up to 10 weeks of parental leave after the 14 weeks of maternity leave (the parents are permitted to make their own decision as to how many weeks each will take).

Aim parental leave may be taken to take care of the person apos s own children under the age of 9 years for periods of at least 13 weeks and up to one year.

If a woman wishes so, she may also be given additional leave, without pay, to care for her child until the child reaches the age of three.

During the year when the survey was conducted, mothers had the right to 56 days of maternity leave after giving birth, subsequent to which they could also use a parental leave until the child attained three years of age.

It is also concerned about the constraints for obtaining unpaid maternity leave and the lack of awareness by women of existing unpaid parental leave rights.

The norm included in the Labour Law provides Every employee shall enjoy the right to a childcare leave in view of the birth or adoption of a child.

(c) To give people a better quality of life, for instance by making it possible for them to take parental leave to take care of their children.

In relation to both categories she is entitled to 14 days pre confinement leave, which, if unutilized owing to the early birth of the child, can be taken after confinement.

Child care leave may also be used, all at once or in installments, by the father of the child (article 165 of the Labour Code).

(c) Non insured employees, non insured self employed persons and persons receiving cash assistance may also obtain parental leave

(iv) Maternity and child care leave

The Law on labor allows for a father of the child to use the right to maternity leave in case of the child's mother's death, in case the mother abandons the child, or if she is prevented from exercising this right due to valid reasons.

224. The mother apos s right to request the maternity or nursing allowance in cash payments expires six months after the date of expiry of the period provided for each allowance 90 days for the maternity allowance and eight months of age of the child for the nursing allowance (article 40 of Decree Law No. 22482).
