If it was an official act, but performed badly, the usual administrative sanctions against the individual would apply.

(f) Judicial and administrative sanctions against persons liable for the violations

The Administration has elected not to do so.

It had established focal points for the management of spare parts in missions and had proposed the creation of a Spare Parts Management Officer post at United Nations Headquarters.

The Committee, which presented its report on 8 March, concluded that there had been administrative and financial malpractices and recommended, inter alia, that appropriate remedial measures be taken.

C. Protection against retaliation for exposure of wrongdoing or reporting of irregularities and misconduct

In those cases, actions or omissions by the municipal authorities which have blocked these initiatives have been verified. For example, in the case of the Human Rights Committee of the hamlet of Ceiba Amelia in Escuintla, the local authorities did not know what administrative actions were needed to respond to a petition for municipal endorsement.

Noting also that violations of the United Nations Financial and Staff Rules and Regulations and administrative instructions are considered misconduct and call for disciplinary action,

Anomalies had been found in four cases and had been dealt with administratively within GSS, and sanctions taken against those involved.

The Committee considers this to be unacceptable and requests the administrations to take immediate action against those who continue to disregard proper procedures.

Nor is there any question that gross and massive violations of human rights that occur on territory not under the real control of a Government should be regarded as international crimes, in other words they should not be regarded as acts of the State on behalf of which the Government in question is acting.

The Secretary General is finalizing a comprehensive policy to ensure protection against retaliation for reporting of alleged misconduct.

The Administration considered that it would be successful in recovering the majority of these losses.

The Administration should expedite that review.

According to the Administration, changes and enhancements continue to be made to the personal recovery system.

18. The Board recommends that the Administration ensure full compliance with the administrative instructions.

Policy dialogue is poorly linked to action on the ground.

This is an unwelcome development, as politicians and public officials (parliamentarians) are not above the law and should be accountable.

The administration obtained three legal opinions, which recommended against pursuing action because of the low likelihood that there would be any financial recovery.

While engaging in discrimination against women is not cited as conduct unbecoming, a case could possibly be made against a public official under the Government of Pakistan Conduct and Efficiency Rules for showing prejudice or bias including on the basis of sex.

The Administration will endeavour to implement this recommendation.

Comment by the Administration.

Therefore, this part of the recommendation is not accepted because it cannot be implemented by the Administration.

23. The Board recognizes the efforts made by the Administration to complete the conversion process.

In view of the above, the Administration maintained that it was expedient to continue with the existing practice for the time being.

The Board recommended, and the Administration agreed, that as part of the ongoing reforms, the Administration should determine and implement the optimum ratio of personnel engaged in programme activities to those engaged in administration and management.

It was also argued that the purpose of sanctions was to change the behaviour of the holders of power and that those who held power did not always coincide with the Government of a State.
