The authors have stated that, for the past 50 years, they have pursued domestic remedies through political channels.

quot (b) directly apply for recognition of a foreign proceeding, request relief pursuant to article 12, and seek cooperation in accordance with article 15

3.8 As to the exhaustion of domestic remedies, the author argues, with respect to the pending civil complaint, that a victim is only required to pursue one remedy to exhaustion (that is, the criminal complaint), even if other remedies are available.

On the basis of the information before it, it concluded that no effective remedies existed which the author should pursue on behalf of his granddaughter.

Of particular importance was the principle of the exhaustion of local remedies in the context of diplomatic protection.

Persons likely to face racism and discrimination should be informed of remedies available at the international level, such as that provided by article 14 of the Convention, so that they can seek satisfaction before international bodies when domestic remedies have been exhausted.

It is further submitted that as a matter of law the Canadian Government had no legal authority or mandate to waive the veterans apos rights to a remedy for the gross violations of their rights.

6. Remedies, compensation and restitution

Belgium noted that the process for seeking redress varied from 1 month to more than 36 months.

Twenty seven States reported that the law guaranteed that victims were treated fairly, informed of their rights to seek redress and involved in the process to obtain redress.

That Mr. Barbaro was not informed of potential judicial remedies by the judicial authorities of South Australia did not absolve him from seeking to pursue avenues of judicial redress.

Accordingly, the relief under article 16 was only available upon recognition, and the provisional relief provided in article 15 required at least the filing of an application for recognition.

5.1 With respect to the requirement of exhaustion of domestic remedies, the author notes that she was not informed about any remedies other than appeals directed to the Government.

Mere doubts about the effectiveness of such remedies, or the belief that the resort to them may incur costs, do not absolve a complainant from pursuing them.
