In December 2004, Transcargo Panalpina, an international freight forwarder which maintains correspondent relations with Transcargo in order to transport 1,800 vehicles from Asia to Cuba, was forced to carry out a trans shipment in a third country.

If the goods arrive as cargo they are locked in the Valuables Cage until the arrival of the consignees' agent when they are examined by Customs in his presence.

These circumstances may qualify (under national law) as creditors default' (the consignee being the creditor of the carrier), agent (or bailee) by necessity' (the carrier being such agent or bailee) and the like.

Often, the big shippers are themselves carriers, namely freight forwarders, who do not operate any vessels, but have contracted with smaller shippers to transport the cargo from door to door.

In the process, IAPSO coordinates the services of other selected agents for laboratory analyses, pre shipment inspections, freight and insurance, etc. using the application's e logistics management module developed in 2002.

(b) Although declarations made by freighters, consignees or shipping agents to customs might be legal, firearms or other contrabands may be concealed in a legal consignment, using different methods to cheat customs

The shipper must try to find the right person to whom delivery should be made, or, if it fails in its efforts, the shipper may take the responsibility for a proper delivery itself by, for instance, requesting the carrier to store the goods on its behalf.

Freight forwarders may thus be both carrier (vis à vis the smaller shipper) and shipper (vis à vis a unimodal carrier, such as a sea carrier).

(c) If the consignee does not claim delivery of the goods from the carrier after their arrival at the place of destination, the carrier must so advise the controlling party or, if it, after reasonable effort, is unable to identify the controlling party, the shipper.

In line with article 86 of the United Nations Convention on Contracts for the International Sale of Goods, such consignee when taking delivery from the carrier does so on behalf of the seller.

Goods and vehicles are declared in the customs house by the following sequence

If the goods are sold under paragraph 2(c), the carrier must hold the proceeds of the sale for the benefit of the person entitled to the goods, subject to the deduction of any costs incurred in respect of the goods and any other amounts that are due to the carrier.

The reasons for this are that the chapter should only regulate the liability between the carrier and the shipper and that the question of the position of the free on board , or FOB seller does not belong in a convention on carriage of goods, but rather in a convention on sale of goods.

From the '30s on, road systems expanded, trucks took the place of railroads, fresh food began to travel more.

Some felt that the latter was the more practicable solution, since it was common for a shipper seller to instruct the carrier to contact him on arrival at the destination immediately before delivery.

(b) The character or condition of the goods or the circumstances and terms and conditions under which the carriage is to be performed are such as reasonably to justify a special agreement, provided that ordinary commercial shipments made in the ordinary course of trade are not concerned and no negotiable transport document or negotiable electronic transport record is issued for the carriage of the goods.

These posts are requested to streamline the disposal of written off assets, inventory and facilities management and to improve the control of cargo movements.

Servants and agents of the carrier and other maritime performing parties

Although the carrier would prefer never to be sued at all (or, barring that, to be sued only in the place designated in a forum selection clause, cf. supra note 2), if the carrier is going to be sued in the claimant's jurisdiction it would generally prefer to be sued at the port through which the goods passed rather than at the inland location in which an agent collected or delivered the cargo.

The United Nations Commission on International Trade Law (UNCITRAL) prepared a draft instrument on the carriage of goods with a view to modernizing and universalizing law on the international carriage of such goods.

And the idea of using technology is perfect for us.

Transport of dangerous goods in Norway is regulated through the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR) and Regulations concerning the International Carriage of Dangerous Goods by Rail (RID) respectively.

When the carrier delivers upon instruction of, in principle, the controlling party, the carrier is discharged from its obligation under the contract of carriage to deliver to the consignee.

For a traditional port to port shipment, the port of loading is the place of receipt and the port of discharge is the place of delivery.

Customs and appropriate officers will then verify the consignment prior to delivery to the consignee.

Subject to article 12, the responsibility of the carrier for the goods under this Convention covers the period from the time when the carrier or a performing party has received the goods for carriage until the time when the goods are delivered to the consignee.

The most notorious symptom of this was the emergence of stagflation simultaneously rising inflation and unemployment. Something had gone wrong with the system of economic management bequeathed by John Maynard Keynes.

SDS (Cargo Declaration System) This system will permit the informatic treatment of cargo declarations concerning the entry, transit and exit of goods in Portugal. This system is in test phase.

A contract that contains an option to carry the goods by sea shall be deemed to be a contract of carriage provided that the goods are actually carried by sea.

The carrier that delivers the goods upon instruction of the controlling party or the shipper under this paragraph is discharged from its obligations to deliver the goods under the contract of carriage.

(b)b. Country of transit or transhipment

Arrangements for the protection of a vessel are made by a vessel owner or operator through the services of an agent who works on behalf of a local administration.

In the absence of any such specific provision in the contract of carriage or of such customs, practices, or usages, the time and place of delivery is that of the discharge or unloading of the goods from the final vessel or vehicle in which they are carried under the contract of carriage.

(b) the time of delivery of the goods is prior to the completion of their final discharge under the contract of carriage.

The shipper must deliver the goods ready for carriage, unless otherwise agreed in the contract of carriage, and in such condition that they will withstand the intended carriage, including their loading, handling, stowage, lashing and securing, and discharge, and that they will not cause injury or damage.

On request of the carrier or the performing party that delivers the goods, the consignee must acknowledge receipt of the goods from the carrier or the performing party in the manner that is customary at the place of destination.

The Protocol provides for the simplification of procedures and requirements for the transit transport of dangerous goods in ASEAN countries, using the Recommendations on the Transport of Dangerous Goods Model Regulations and the European Agreement concerning the International Carriage of Goods by Road.

It was also suggested that the words any shipment should be substituted for the word shipments to emphasize that the provision applied to the terms that regulated each of the shipments, effected under a volume contract, that fell under the scope of application of the draft instrument.

For example, article 26 it is necessary to make a distinction between containerized cargo and other cargo, because of the fact that the carrier may carry the former type of cargo on deck without a specific agreement with the shipper.
