10. In section 11 of the new Act on Administrative Procedure of 1993 an important principle of equality has been enacted, intended to apply in the course of administrative procedure.

The Administrative Procedure Act sets out the principles of ensuring the protection of fundamental rights and freedoms of persons and good governance.

(b) The amendments to the Family Act, the Criminal Code and the Criminal Procedure Act in 2003

The main aim of enacting the Administrative Procedure Act was to guarantee people the maximum security under the law when decisions of this type are taken in their dealings with the State.

Procedure 148 was added to the Aliens Act Implementation Guidelines at the time the Aliens Act 2000 came into effect.

The new code also introduces the concept of administrative receivership, whereby lawyers, certified accountants, and other intermediaries act as managers of enterprises undergoing bankruptcy. The procedure abolishes the Liquidation Team, a long standing regime that many alleged was unjust, aggressive in administrative intervention, unprofessional, and unaccountable.

6. In addition, Act 4 1992 introduced the principle of discretion throughout the procedure.

80. The new Children apos s Act codified rules on official procedure and rulings in cases referred to the authorities under the Act.

The Judiciary Act and the Code of Civil Procedure was amended on 1 January 2002.

In principle, if a woman believes that an administrative act discriminates against her, she may ask the administrative judge to annul it.

Two laws were adopted in that connection Act No. 96 05 of 6 February 1996 establishing administrative districts and local communities and Act.

87. In the old Act, provisions on procedure in child welfare cases were scattered among various articles.

The Somali Code of Criminal Procedure of 1963 was based upon an amalgamation of the Italian Code of Criminal Procedure of 1953, the British Criminal Procedure Ordinance of 1956, and the Indian Evidence Act of 1872.

The summary nature of the record is expressly provided for by article 743 of the Criminal Procedure Act.

77. Various amendments were made to the rules of the older Act on procedure in cases involving custody.

Notable among these legislative achievements is the enactment of the new Code of Criminal Procedure (Act No. 16.893).

That, however, was a normal administrative procedure, which bore no relation to the experiment approved by the General Assembly.

Here too, there are only a small number of fundamental provisions to be found in the Youth Courts Act and in the Code of Criminal Procedure, whilst everyday life in prison is largely determined by national administrative provisions, the Remand Detention Code.

The conditions of and procedure for the acquisition, resumption and loss of Estonian citizenship are regulated by the Citizenship Act.

Changes had also been made to the Code of Criminal Procedure and the Hindu Succession Act to empower women further.

The Act was recently amended with the aim of further adapting procedure to the special demands made in juvenile cases.

(c) The situation concerning the draft Code of Criminal Procedure and of the Organization Act relating to the Prosecution Service

According to the Courts Act, lay judges participate in the administration of justice in county and city courts on the bases and pursuant to the procedure provided by the codes of court procedure.

89. As regards legislative changes other than those discussed above in connection with the statutes dealing with children, mention should be made of the great reforms that have been enacted through the first codification of general rules on the handling of cases at the administrative level, i.e. the Administrative Procedure Act, No. 37 of 1993, which came into force on 1 January 1994.

Domestic violence was sanctioned as a criminal act under the Criminal Code, and the procedure followed was therefore a criminal one.

Since Mr. Bacale refused to appear, a warrant was issued for his arrest under article 487 of the Criminal Procedure Act.

Article 139 of the same Act also defines the administrative penalties applying to any infringement of the Act's provisions.

Enforcement of the provisions of the Competition Act is in the hands of administrative bodies and the judicial authorities.

The Occupational Health and Safety Act and the amendment act to the Product Safety Act provide for occupational health and safety requirements for work the duties of employers and workers in creating and ensuring a working environment which is safe for health the organisation of occupational health and safety in enterprises and at state level the procedure for conduct of administrative challenge proceedings, and liability for violation of the occupational health and safety requirements.

The procedure applicable to trials of capital offences in Singapore and the evidence that may be adduced therein are provided for in the Criminal Procedure Code (Cap. 68) and the Evidence Act (Cap. 97).

91. An appeal can be addressed to the people apos s court, which rules according to the Administrative Procedure Law of 1990.

1. The Federal Act of 1993 amending the Code of Criminal Procedure has limited the obligation under section 84 of the Code of Criminal Procedure of official psycho social counsellors to report offences for prosecution.

It was to be hoped that any judgements given would be seen as an act of justice, not just a mere procedure.
