Remarks on the draft text of model legislative provision on written form for the arbitration agreement, revising article 7 of the UNCITRAL Model Law on International Commercial Arbitration

At its thirty fifth session (New York, 17 28 June 2002), the Commission adopted the UNCITRAL Model Law on International Commercial Conciliation.

Articles 7, 8(1) and 35 of the UNCITRAL Model Law on International Commercial Arbitration (MAL) contain provisions similar to those of the New York Convention.

The Working Group suspended its deliberations in order to complete the UNCITRAL Model Law on International Commercial Conciliation and the draft provisions relating to interim measures in arbitration.

The phrase commercially reasonable originated from language used in article 5 of the UNCITRAL Model Law on International Credit Transfers, and article 4A of the Uniform Commercial Code (UCC).

Recalling its resolution 40 72 of 11 December 1985 regarding the Model Law on International Commercial Arbitration,Official Records of the General Assembly, Fortieth Session, Supplement No. 17 (A 40 17), annex I.

However, it was disappointed that the issue of ex parte interim measures continued to delay conclusion of the draft revisions to the Model Law on International Commercial Arbitration, and joined with others in seeking a speedy resolution.

At its thirty fifth session (Vienna, 19 30 November 2001), the Working Group considered draft model legislative provisions on conciliation (on the basis of documents A CN.9 WG.II WP.115 and A CN.9 WG.II WP.116) and approved the final version of the draft provisions in the form of a draft model law on international commercial conciliation.

3. Recommends that all States give due consideration to the enactment of the Model Law, in view of the desirability of uniformity of the law of dispute settlement procedures and the specific needs of international commercial conciliation practice.

In particular, notwithstanding the wide divergence of views, the Working Group had agreed to include a compromise text of the revised draft of paragraph 7 in draft article 17 of the Commission's Model Law on International Commercial Arbitration.

It is tempting to conclude that the Fed s eagerness to tighten monetary policy despite unfavorable historical precedents and ongoing economic uncertainty is driven by commercial banks with excessive influence in official policymaking. After all, commercial banks business model works only when the banks can earn (via passive and relatively safe long term investments) at least 3 a year more than they pay depositors.

Separately, although the Government acknowledges that the model status of forces agreement permits UNMIS to clear goods free of charge, it is requiring the Mission to engage the services of a commercial clearing agent, at significant expense to the United Nations.

Lastly, he noted that 2005 had marked the twentieth anniversary of the adoption of the UNCITRAL Model Law on International Commercial Arbitration and the twenty fifth anniversary of the United Nations Convention on Contracts for the International Sale of Goods.

Eventually, the new model will replace the old model.

Second, repeal of the Glass Steagall Act, which separated commercial and investment banking, was a mistake. The old model of private partnerships in which partners had an incentive to monitor each other to avoid reckless investments gave way to one of public companies aggressively competing with each other and with commercial banks to achieve ever rising profitability, which was achievable only with reckless levels of leverage.
