Guardianship

In the legal system of BiH both Entities the adoption matters are entrusted to the center for social work as the authorized body of guardianship.

In several countries where guardianship arrangements are developing, UNHCR has contracted NGOs to arrange for the care and guardianship of unaccompanied and separated children.

The father followed by the agnatic grandfather shall have guardianship of the same minor and his assets and shall be bound to undertake such guardianship.

The decision of guardianship over child, in each independent case, will be brought by the authorized body of guardianship (center for social care) in the best interest of the child.

Article 128 determines the cases in which the father forfeits his guardianship.

Family members are subjects of rights and obligations (Family and Guardianship Code).

This law deals with the issue of marriage, family relations, adoption, and guardianship.

Likewise, the act makes provisions for equal guardianship over minor children of their marriage.

(f) Under civil and family law, tutors and guardians are appointed by tutorship and guardianship authorities.

In custody the mother has the preferential right while in guardianship the father has the better right.

Women have the same rights as men with regard to guardianship, wardship, trusteeship and adoption of children.

In January and April 2002 respectively, in the light of the review foreshadowed in paragraph 411 of the initial report, the Law Reform Commission released reports recommending that the Government simplify the guardianship of children and strengthen the existing legal protections against parental child abduction.

The duties associated with the tutorship and guardianship of a child are performed by the tutor (or guardian) without compensation.

The reforms foreshadowed in paragraphs 173 to 175 of the initial report, including the establishment of a Guardianship Board, are now in effect.

There are 837 Guardianship Councils, 221 Public Prosecutor's Offices for Children and Adolescents, 202 Child and Youth Courts and 119 Municipal Councils for Women.

The child of unknown descent or who is legally assimilated to this status shall have the right to guardianship and care but without adoption.

The benefit for the performance of guardian's duties is 38 LVL and it does not depend on the number of children placed under guardianship.

The father and otherwise the agnatic grandfather shall have exclusive guardianship in regard to safeguarding, disposing of and investing the property of a minor.

At the district court level, guardianship and curatorship cases involving minors and criminal cases involving juveniles are now handled by the same court division.

If a parent fails to perform the duty to provide maintenance to a child, a court will, at the request of the other parent, guardian or guardianship authority, order support for the child to be paid to the parent who submitted the claim or to the guardian or person in whose interests the guardianship authority submitted the claim.

The two laws recently promulgated for members of the Roman Orthodox and Syrian Orthodox communities, however, contain a section on guardianship and were both approved.
