428. Family relations are governed by civil law. Article 148 of the Civil Code of the Federal District establishes, among other considerations, the age required to enter into marriage

Laws such as the civil code, the nationality law and the labour law should be targeted for priority action to bring them into full conformity with the Convention.

Since 1978, when Law 855 amending the Civil Code was passed, no substantive changes had been made in our legislation to benefit women, so that this new code represents a step forward in this direction.

The Civil Code does not apportion legal capacity by gender.

Although the CRM in its article 67 makes use men and women are equal before the law the existing Family Law which is an integral part of 1966 Civil Code, there still is Law of the effective Family who is integrant part of the Civil Code of 1966, there are still many factors contributing to discrimination against women, among which we mention the following

The civil laws are based on Egyptian civil law.

In line with the Committee's general recommendations, Paraguay had amended its Civil Code, Labour Code, Electoral Code and Penal Code, which now defined sexual harassment and domestic violence as serious offences.

There has been progress in reforming family law, particularly through the draft Code of Persons and the Family and the draft revisions to the Civil Code, which the government is now examining for early submission to the National Assembly.

Violation of the rights shall be penalized legally, once all mechanisms foreseen in the general law, namely the Civil Code, the instauration of the corresponding indemnity and or criminal charges in accordance with the law.

According to the Civil Code and the Code on Administrative Offences, legal entities might be subject to property and administrative liability.

Under article 23 of the Civil Code, no one may be restricted in terms of legal capacity, except under the conditions and in the manner established by law.

Article 9 of the Code of Civil Procedure guarantees due process based on principles that render citizens equal under the law and before the courts, regardless of sex.
