One approach is for the valuation, at least in the first instance, to be determined through agreement by the parties (being the debtor, or insolvency representative, and the secured creditor).

Domestic reforms to be considered might include (a) increased transparency and disclosure (b) strengthening of domestic regulatory standards and (c) more effective burden sharing arrangements, such as improved insolvency and debtor creditor regimes.

In short, monetary policy is perpetuating the disequilibrium between creditor and debtor economies in the eurozone, and macroprudential policy is doing nothing to stop it. When interest rates normalize, this could generate serious financial instability.

More recently, creditor countries have been concerned about the financial costs to member governments that have lent to Greece. But Latin America in the 1980s showed that creditor countries stand a better chance of being repaid (in expected value terms) when the debtor countries are actually able to grow.

That treatment, for example, may prevent access to the funds of one company for the payment of the debts or liabilities of a related debtor company (except where the debtor company is a shareholder or creditor of the related company), notwithstanding the close relationship between the companies and the fact that the related company may have taken part in the management of the debtor or acted like a director of the debtor and caused it to incur debts and liabilities.

Such actions are typically governed by general provisions of law (such as the Civil Code) and are not necessarily tied to the existence of an insolvency proceeding against the debtor, and the right to bring them typically belongs to any affected creditor and not to other persons such as the person appointed to administer the debtor apos s assets.

The post Wall generation, whose members are less than 40 years old and thus far removed from WWII, has little appreciation for this cause. For them, debtor and creditor countries increasingly divergent economic objectives are much more meaningful.

Those included in particular a stay of individual creditor actions and of transfers by the debtor of interests in assets, and the possibility for the foreign representative to seek from the court additional relief appropriate in the circumstances.

But any solution will be unacceptable unless it finds broad acceptance across Europe, in debtor and creditor countries alike. There is no reason why a constitutional solution that involves debt limitation should not command a large measure of public acceptance, especially in debtor countries, which have experienced the political and economic damage caused by previous profligate governments.

A view was expressed that paragraph (3) was superfluous and potentially confusing in a State where a demand of payment or performance served by the creditor on the debtor had the effect of interrupting the limitation period.

The discussion has so far followed easily predictable national patterns Creditor countries do not object to deflation, because it increases the real value of their investment, whereas debtor countries repayment burdens would grow heavier.

It may be that, as between the grantor and the secured creditor, the secured creditor has agreed to treat the proceeds as encumbered assets.

Debtor countries pay substantial risk premiums to finance their debt, which is reflected in their high economy wide borrowing costs. This has pushed them into a deflationary tailspin and put them at a substantial and potentially permanent competitive disadvantage vis à vis creditor countries.

Because of the absence of debtor creditor identity in a large number of receivables payables as recorded in the IMIS database, the Board questions the ability of the Administration to follow up and collect overdue accounts receivable and to maintain proper control over accounts payable.
