According to Greenpeace s study, new fishing vessel construction trends had shown that more vessels were being built with technology for fishing either for large amounts of relatively low valued species or for widely distributed species at depths that were previously technologically and economically unattainable.

16. The Forum endorsed the concept of a vessel monitoring system for the Forum Fisheries Agency (FFA) member countries, which will be progressively tested and implemented, for the Distant Water Fishing Nations vessels operating in the exclusive economic zones of FFA member countries, according to each member apos s wish. Leaders called upon the Distant Water Fishing Nations operating in the region to support the vessel monitoring system initiative of FFA member countries.

Some delegations and non governmental organizations underlined the need to ensure that there was a genuine link between the fishing vessel and the owner and emphasized the need to define the genuine link.

62. Pakistan indicated that deep sea fishing in its exclusive economic zone was governed by the Pakistan Exclusive Fishery Zone (Regulation of Fishing) Act of 1975 and related regulations. Under the Act, no vessel flying the flag of Pakistan was allowed to fish in areas under the jurisdiction of other States.

There was also a case concerning Canada s seizure of a Spanish fishing vessel on the high seas in an area in which Canada claimed the right to take protective measures to preserve fish stocks.

A third delegation stated that it had required the mandatory installation of vessel monitoring and surveillance systems and planned to set up special tribunals to deal with the issue of illegal, unreported and unregulated fishing.

According to the scheme, when a fishing vessel is in the port of a Contracting Party, its duly authorized inspectors are entitled to monitor compliance with the Commission s conservation measures for all ICCAT managed species.

For cases in which a violation has occurred, the flag State concerned is required to notify ICCAT of actions it has taken to address the violation vis à vis the fishing vessel flying its flag.

However, almost all contents of the Agreement such as the system for permission or approval of fishing vessel operations on the high seas, the marking of such vessels, the obligation to keep records of fishing vessels and approval by the Minister of International Trade and Industry with regard to export of fishing vessels had been implemented by existing national laws, such as the Fisheries Law, the Fishing Boat Law, the Export Trade Control Order and other regulations under the Fisheries Law.
