In October 1996 the Ministry of Information prepared a draft sub decree on the Press Law.

The crime of abuse of the press is defined as follows in article 43 of the Press Law (1) For purposes of this law, an abuse of the press shall be deemed to be any act or behavio u r that injures the juridical values and interests protected by the criminal code, effected by publication of texts or images through the press, radio broadcasts or television.

Warnings can be given in cases of violation of the Law on the Press by the founder, the registering body (the State Committee for the Press) or the Prosecutor.

The Act of 29 July 1881 on Freedom of the Press establishes a specific regime for press offences, by derogation from the ordinary law of the Penal Code and the Code of Criminal Procedure.

The adoption of a new law on restricting the press through the implementation of decrees could be used to control the public media and influence the private press on occasions such as that of November 2004.

164. In January the Ministry of Information requested comments from COHCHR on two draft executive acts issued under the Press Law a sub decree defining national security and political stability and a proclamation on press identification and registration.
