Before the adoption of the 1993 MLM Convention, ship suppliers had a maritime lien in respect of their claim.

In addition, it was noted that priority under the draft Convention gave a creditor only the right to be paid before other creditors that were subsequent in the line of priority.

In summary, the proposal clearly set out maritime liens recognized under Article 4 of the MLM Convention and provided a means of enforcing maritime liens other than those recognized in Article 4 of the Convention, but no State was required to enforce maritime liens arising under Article 3 (1) (b).

The Grand Duchy of Luxembourg, pursuant to article 42, paragraph 1 (c), of the Convention, will be bound by the priority rules set forth in section III of the annex, namely those based on the time of the contract of assignment.

Part A includes revised draft articles for a convention on arrest of ships, and part B contains draft final clauses prepared by the secretariats on the basis of the final provisions of the 1993 International Convention on Maritime Liens and Mortgages (1993 MLM Convention).

In addition, it was stated that legal opinions varied greatly as to whether article 12 of the Rome Convention was applicable to questions of priority or to any other question relating to property rights.

5. With respect to the relationship between maritime claims and maritime liens , the observer for the International Maritime Committee (CMI) noted that, in ensuring that maritime liens recognized by the 1993 International Convention on Maritime Liens and Mortgages (MLM Convention) were covered by the definition of maritime claim , there was no need strictly to use the same wording, since maritime liens were by nature more restrictive than maritime claims .

228. As to prior conflicts, wide support was expressed for the approach taken in the draft convention combining substantive and private international law priority rules.

The new text as drafted in Lisbon was more precise and in line with the approach adopted by new conventions such as the 1993 MLM Convention.

The changes introduced into the 1993 MLM Convention, as well as the new Arrest Convention, would considerably weaken the position of ship suppliers.
