Most importantly, the accumulation of such objections might induce the reserving State to withdraw the reservation.

Under normal circumstances, only the reserving State itself was in a position to interpret and explain the nature of its reservation, the reasoning behind it and its compatibility with the treaty.

Some considered that reservations to such treaties could be separated from consent to be bound by the treaty so that the latter might become binding for the author of the reservation without applying the reservation.

That criterion seemed sufficient to safeguard the integrity of a treaty, given that it applied when reservations were prohibited or declared impermissible.

4. Any State party which has made a reservation in accordance with paragraph 3 of this article may at any time withdraw that reservation by notification to the depositary.

The monitoring bodies could express an opinion on the permissibility of a reservation but they could not declare it null and void or draw the consequences of their determination.

It was noted that invalid reservations could not by definition achieve the result desired by the State that made them.

At its 2859th meeting, held on 28 July 2005, the Commission decided to send draft guidelines 3.1 (Freedom to formulate reservations), 3.1.1 (Reservations expressly prohibited by the treaty), 3.1.2 (Definition of specified reservations), 3.1.3 (Reservations implicitly permitted by the treaty) and 3.1.4 (Non specified reservations authorized by the treaty) to the Drafting Committee.

The determination of the admissibility of a reservation was a prerogative of States and only States could define the consequences of the inadmissibility of reservations.

So it can be assumed that the rest still stands.

The objecting State might also expect that its objection, by conveying disapproval, would open the way for what the Special Rapporteur had referred to as the reservations dialogue by encouraging the reserving State to reconsider the need for or the content of its reservation.

(11) This might not be true of all categories of reactions to a reservation, which might show misgivings on the part of their authors without amounting to an objection as such.

(1) Under draft guidelines 2.3.1 to 2.3.3, the contracting parties may also object not only to the reservation itself but also to the late formulation of a reservation.

Except where a specific reservation is expressly authorized by a treaty, the other contracting parties are always free to reject it and even to enter into treaty relations with its author. A statement drafted as follows

Second, a State might consider that the reservation was incompatible with the object and purpose of the treaty but preferred to present a simple objection in order to maintain the reserving State within the treaty with respect to itself.

If the prohibition on reservations applied only to certain articles, or, conversely, if reservations were authorized only for some provisions, the depositary must refuse such reservations as were not in accordance with the provisions of the treaty.

Conversely, where the reservation was not compatible with the object and purpose, the State could not be regarded as being a party to the Convention.
