Principle 28 Restrictions on the practice of amnesty

PRINCIPLE 28. RESTRICTIONS ON THE PRACTICE OF AMNESTY

The commission has no power to grant amnesty but can determine the political crimes in respect of which an amnesty law can be adopted.

Among the pioneers were the Amnesty Committees in Brazil, the International Secretariat of Jurists for Amnesty in Uruguay (SIJAU) and the Secretariat for Amnesty and Democracy in Paraguay (SIJADEP).

It is said that efforts by human rights organizations to seek a repeal of the articles of the amnesty law granting a pardon to human rights violators and the law prohibiting judges from deciding on the legality or applicability of the amnesty law have resulted in death threats against some members of these organizations.

Cases of re arrest, despite the Amnesty Law, give further cause for concern.

The Minister informed the Special Rapporteur that the law resulted in the release of 96 persons, but that some 27 had evidently been re arrested, accused of war crimes or criminal offences not covered by the Amnesty Law.

4. Amnesty decrees

In May 2004, a draft law on amnesties presented to Parliament was withdrawn because it would have assigned the power to grant amnesties to the President and not to Parliament.

Similarly, amnesty would not be a bar to investigation before the international judicial commission of inquiry because of the limited material scope of the amnesty, and the legal basis of the commission.
