The group also reviewed the preambular paragraphs and final provisions, as well as the remaining draft articles.

The suggestion was made that the third preambular paragraph should be transferred in its entirety to article II, paragraph 1 (a).

With respect to the drafting of the revised preambular paragraph, these delegations expressed a preference for placing the provision in an operative paragraph, as a saving clause.

Thus, the numbering of the articles has changed.

In that regard, a working group of the Sixth Committee should be set up in order to draft the preamble and final clauses of the draft convention, including those relating to dispute settlement.

In that particular case, some of the elements that were included in the third preambular paragraph could not be found in article II, paragraph 1 (a).

In terms of treaty making technique, it was stated that it was not customary to refer in the preamble to details that were found in the articles of a treaty.

Jordan preferred for the articles to take the form of a convention, for which reason they should be supplemented by a section dealing with the settlement of disputes together with a preamble and final articles.

It was also understood that the language to be used in the third preambular paragraph was linked to article II, paragraph 1 (a).

This is consistent with Article 28 of the Universal Declaration of Human Rights, which states that, Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized.

The States parties will continue their endeavours to strengthen the review process of the operation of the Treaty, with a view to assuring that the purposes of the preamble and the provisions of the Treaty in their entirety are being realized.

A general provision requiring non discrimination has been inserted into the preamble of the Constitution (Fundamental Law) and provisions on equal treatment of men and women in employment and in the labour market have been reinforced.

It had to be borne in mind that the preamble stated that the rules of customary international law continued to govern matters not regulated by the provisions of the Convention.

It was noted that articles 16(1) and 17(3), as well as the proposed new paragraph (3)(c), already distinguished between foreign main and non main proceedings for the purposes of the effects of recognition and the relief available to the foreign representative.

The bill takes a gender approach in both its form and its content, using non discriminatory language and including provisions to replace existing ones which treat women refugees automatically as men apos s dependants.

Paragraph 2 of that article could never be construed to mean that a State s military forces had the right to engage in unlawful activities, as was clear from the eleventh preambular paragraph.

14. In a spirit of compromise and cooperation his delegation could accept the addition of the eleventh preambular paragraph, provided that article 1, paragraph 4, and article 19 were also included in the text.

It was regrettable, however, that the provisions of the Model Law departed from those of the recently adopted European Convention on Insolvency Proceedings.

The former was affirmed in article 21 (1) of the Universal Declaration of Human Rights, article 25 (a) of the International Covenant on Civil and Political Rights, articles 2 (2) and 3 (3) of the Declaration on Minorities and article 6 (1) (b) of ILO Convention No. 169, while the latter was recognized in article 6 (1) (c).

This collection with five numbers contemplates 30 articles of this declaration.

2. The Working Group of the Whole shall maintain its Drafting Committee which shall consider the provisions of the draft articles prepared by the International Law Commission that it was unable to consider in its previous meetings, as well as the draft preamble and the set of final clauses.
