For the reasons stated above, however, the Panel is unable to consider recommending payment to any claimant for whom a payment order has not been filed by Egypt and whose identity and amount claimed are not specified.

Specific responsibilities borne by Governments include informing claimants of the criteria for compensation submitting claims to the Compensation Commission on behalf of their nationals affirming that there is no reason to believe that information stated in claim forms is incorrect distributing payments and providing reports to the Commission on the amounts of payments.

If compensation were to be approved for an amount in excess of that for which payment orders have been provided by Egypt, effecting payment of the compensation to the claimants would require the names of the claimants and the respective amounts approved, which have not been provided by Egypt.Further, the Panel notes that the consolidated claim filed by Egypt concerned deposits, the existence of which Egypt was aware of at the time of filing the claim.

It was noted that that limitation of the tort receivables to be covered in the draft Convention was due to the fact that, in the absence of such a confirmation, a tort receivable arising from an illegal act was of no value for financing purposes.

The Governing Council is the policy making organ of the Commission and approves the award and payment of all compensation claims.

(e) Whether the bill authorizing the Government to pay compensation as a result of decisions taken by intergovernmental bodies had been passed and what provision had been made for the payment of compensation

It should be noted that the excess amounts previously awarded in respect of the claim will be deducted from the total recommended compensation in respect of the matching category D claim.

However, the amount of compensation for successful claimants in categories A and B was fixed by the Governing Council at a relatively low level, while the electronic compensation formulae developed by the category C Panel of Commissioners took into account the possibility of fraud and resulted in the Panel recommending modest amounts of compensation.

22. Further, the Panel recommends approval of corrected recommended amounts for three claims from the second instalment.In December 1996, the Governing Council accepted the Panel s recommendation that pursuant to Decision 24, in the case of 42 confirmed matches of category A claims and category C1 quot departure claims from the second instalment, appropriate deductions be made from the compensation awarded to the category C claimants.
